I get a call from the resolution center today .My ex wants to modify our parenting plan , OK (wants more money) my first thought so I call the Ex and say why didn't you tell me first so we could discuss it ! She informs me that this is happening because I called her a name on the phone the other day (I do not deny this since I call her names frequently ) . I am not going into details but this women is abusive .I am going to take this opportunity to try to get custody of my children as things seem to be getting worse in her world lately .
This women is wacko . Shortly after I hang up the phone my mother calls apparently the Ex called her and said I threatened her ( I don't deny that I said I wish she would fall off her boat and drown) Is that a threat? I know what is coming ,she knows I am a Firearms enthusiast . she is going to use the Court system to get some revenge on hotbiggun (restrainingg order will be next I'm sure) . WTF She has made my life hell for the 14yrs that we were married and she just wont leave me alone .What drives people to do this kind of shit ? It's been 4yrs I am remarried to a wonderful women .My life is good ,But this women just seems to pop up once in a while to stir the pot . I'm not bitter .I'm not a deadbeat dad Hell she gets more than 1/3 of my pay check + I buy them Clothing and everything else they might need . Rant over and edited for any legal liability it may cause me . |

Doesn't sound like you threatened her, you just wished the worst. In CA a threat has to be direct and the person being threatened has to have a valid reason for believing you were going to carry out the threat and harm them. Such as holding a gun to their head saying "I am going to f'ng kill you" is a direct threat. Wishing she falls off a boat, not a threat because you did not imply you were going to push her off a boat. Although, she might be able to use the fact you own guns against you. I'm not an expert, just served on a few criminal jury's

Watch what you say on the phone. My ex BIL tried to get his kids from my sis and she was smart enough to save the calls of him wishing her dead etc. Needless to say I kind of chuckled when the tapes were played in court and I got to witness an epic face palm.
p.s. the judge wasn't amused either and adjusted his child support to the max. |

I know trying to get custody will be a battle I may not win especially with Wa St court system .But I have to try .I have felt massive guilt since i left 4 yrs ago. |
