For the sake of discussion, say you've been off work for two months due to a medical condition.  In that time you've been hospitalized twice and undergone 13 rounds of outpatient treatments.  Because you've been off due to a serious medical condition your employer isn't going to fire you.  They are, however, yanking your benefits (no more medical/dental insurance) because you've exhausted FMLA leave.

You want/need to go back to work, but the doctors say you can't.  You haven't seen a paycheck for months now.  No problem, you have disability insurance for just this thing.  Guess don't count on it.  All that and tthe claim is denied.  Apparently only ghetto rats/lifer FSA'ers qualify for that.  This is a private insurer, not social security.

No income, you're employed but can't go back to work until you get a Dr sign off...which they wont.  What do you do?

1) Beg current employer to fire you in hopes of maybe recieving unemployment comp?  You're losing the bennies anyway.

2) Find new job, keep mouth shut about any medical issues.

3) Appeal the denied claim...keep appealing.  Possibly consult one of those lawyers advertising on Judge Judy

appeal the insurance company decision, contact the local TV news consumer reporter.

If you need a Dr's note go to another doctor, just say you were sick beyond xyz days and work requires a note to go back to work.
