Several times this month I have been in close calls with other drivers on the road. None of them would have been my fault had I not avoided collision, but my question is, they were easy to see coming, so am I obligated to avoid the accident if I have the ability to do so?

Example, I was taking a right hand turn on a green light at a four way intersection. A van in the oncoming lane decided to take a left hand turn on his green light, since I was turning right on my green I had the right of way.  The asshole would have hit me if I hadn't slammed my breaks on at the last second. So, if I had seen him and known he would hit me, but continued to drive regardless and a accident resulted, would I in any way be liable?

yes, if you would admit to it.

"Failure to avoid an accident" is on the books as a violation in a lot of places.

If I was a cop I'd arrest you just for saying "breaks."

Every day that I drive in King County is an advanced master class in collision avoidance and defensive driving.
The drivers here are the absolute worst I have encountered anywhere.

Get used to it or take the bus.

There are a shit ton of reasons to avoid car crashes.  This isn't a question of morality for me.

This.

Morally? Not really obligated.
Survival? Law of gross tonnage applies.
Legally? Yeah.

From a time wasted perspective? It's gonna suck for awhile until your shit gets fixed, plus all the hassle involved, so it's a good choice to avoid from an efficiency standpoint.

Although, going right up to the point of no return while enforcing one's own right of way... kinda entertaining. Used to drive a crew cab long bed 4x4 Dodge Cummins with a manual and exhaust brake. There's a lot of oblivious people out there that got a wake up call with nice window full or mirror full of 'Holy shit I could have died".

I was behind a guy today who blew a red light in a Dodge dually . It would have been ugly if he had crashed .

A couple months ago, I was driving past the entrance to a gas station. It was on my right, and there was somebody waiting to make a left turn in front of me. Well, not exactly in front of me, because there was a full size pickup with shell in front of me that was making a right into that entrance.

I was screened perfectly. I saw the wheels of the left-turner start to roll forward, and I knew that he didn't see me. After making sure nobody was behind me, I planned an 'emergency stop' in my lane.

Sure enough, my screen went to the right, the left-turner was just rolling on the throttle, and I just got to my point of no return. Hit the brakes, hard, nose dipped down, ABS kicked in for a second, car shook, and the oblivious left-turner saw me and slammed on his brakes. Bam, first gear, big throttle, moved on past him as I did the slow turn to stare at the left-turner.

Found him later, told him "You're welcome for not wrecking your truck." Got a sheepish look on his face because he knew he fucked up. Told him it was a good thing that I saw him.

Could I have barreled through, hoping he wouldn't have crushed the right side of my car? Sure. Would his insurance have paid out? Yep.
Not worth my time.

I always tell myself that the next fucking retard that is about to hit me, im just going to let them hit me so that they hopefully learn a lesson from the shit show that I would turn it into. But me being me, every time I almost get crashed into, I hit the brakes, swerve or whatever else required to avoid the accident. Your welcome to all the terrible drivers out there.

I still rememer these words from an animation in my driver's education class in high school: "You were right --- dead right." Dammit, I just can't get it out of my head.

Several times a month for you OP.
Around here in the Tampa area where I drive it's several times a week, it's that bad.
People do some really stupid shit, so many of them think everybody should just get out of their way.

Not saying that I intend to get into an accident, it just really irks me that these fucking dumb ass people put my life in danger because they aren't paying attention. I almost wish I had a megaphone so I can blare obscenities at them as we go down the road.

I make it a point to nearly hit people when I have the right of way. Maybe they'll think twice in the future.
