Thank you for your interest in employment at xxxx. xxxx is an Equal Opportunity Employer that does not discriminate on the basis of race, color, religion, sex, age, national origin, disability, veteran status, or any other classification protected by federal, state or local law. As a federal contractor, we are required by law to maintain records and periodically compile reports about the demographic makeup of our employees and individuals applying for employment with us in the United States.
We are seeking your assistance in helping us to meet these recordkeeping and reporting obligations. Specifically, we would like you to consider voluntarily providing to us information regarding your gender, race or ethnicity. Rest assured that any information you elect to provide will be considered confidential. It will be used to satisfy our regulatory obligations and will not be used in making any employment decision that may affect you. In addition, the information will be retained as a separate confidential record apart from employee personnel files. If you remain interested in employment with xxxx and wish to complete the application process please click here. This link will take you to a data collection screen where you will have the opportunity to either (1) identify your gender and your ethnicity/race, or (2) specifically decline to provide that information. Completing the data collection form by selecting either option (1) or option (2) is considered to be part of our formal application process. Should you decide not to proceed to the link your application for employment will be considered incomplete and your candidacy for employment will not be considered further. Please understand that while completion of the data collection form is mandatory to further consideration of your candidacy for employment, the determination of whether to provide us with the requested demographic information is entirely voluntary on your part. Your refusal to do so by selecting option (2) on the form will not subject you to any adverse treatment. On the other hand, if you do elect to provide us with demographic information, it will be kept confidential and will be used only in accordance with applicable legal requirements. The reports we are obligated to prepare provide aggregate information and do not identify the demographic characteristics of any specific individual. Thank you, again, for your interest in xxxx. Its the first step in what could be an important opportunity to do your lifes best work.SM I thought optional meant optional. Not optional means required for consideration; and opting out means we won't even look at you...wtf? ![]()

You have to fill out the form, on which you can decline to provide information about your race and other characteristics. What am I missing? The form was filled out, and declined, and this was the response. Basically if I wished to decline, I would not be considered for employment, but they gave me a second chance to fill it out...

I posted this in another read last night. I will never again claim to be a white male on an application. Prove I'm not hispanic, go ahead.
Quoted:
Fdny written test. They give extra points for all types of shit. Minority + 5, woman +10, low income +5 etc etc. they're hiring 2000ish people. The list of scores is public. Not one person who will be hired will have a score of less than 110. That's right, a perfect score is not good enough. |

It would be offensive of you to question my statements on the form that I am half native american, half african american, partially blind, impoverished, and a lesbian who only speaks english as a second language. |

Most companies that have an affirmative action plan are pretty strict on making you at a minimum decline the form. Not administering your plan correctly/fully opens up a huge can of butt hurt. Some companies allow the interviewer to “guess” what your race is, but that opens up a huge area of liability that some companies just won’t accept. If you haven’t been interviewed and don’t fill out the form most of the time your application is circular filed.
I know from experience, the EEOC is not a friend of employers... be prepared to write a check if they ever feel it necessary to contact you. Even if you are in the “right” if they have to contact you, you are “wrong”. |
