My democrat friend (I know oxymoron) insists that guns must be stored unloaded in a gun safe in NEW JERSEY (I know it does suck to live here)

Somebody please provide legal documentation stating otherwise to help me win this argument.

He owes me a free expensinve dinner when I prove him wrong (hopefully he won't want to come along)

New Jersey Revised Statutes § 2C:58-15a states that “[a] person who knows or reasonably should know that a minor [under 16 years of age] is likely to gain access to a loaded firearm at a premises under the person’s control” is criminally liable for a misdemeanor if a minor gains access to a firearm, unless the person:

Stores the firearm in a securely locked box or container;
Stores the firearm in a location which a reasonable person would believe to be secure; or
Secures the firearm with a trigger lock.
This section does not apply to activities concerning the lawful use of a firearm by a minor, or where a minor obtained a firearm as a result of an unlawful entry by any person.  Section 2C:58-15b.

ETA: I couldn't find anything in my 3 minutes of searching that states that the gun has to be stored in a safe if there are no minors present.  But I only looked at the codes in the vicinity of this one.

There are two sets of laws governing firearms in New Jersey. 2C:58 concerns the Firearms Purchaser ID Card and etc. 2C:39 concerns unlawful possession, where you can have it, transport it, stuff like that.

Go to the first title of the chapter you want, click on the cross to the left of it, and it will open up all the chapters.

What is not illegal is thereby legal. The proof is on the OPS freind to prove the statute. You can not disprove that which is not in existance.
