All my properties are in highly desirable/high demand area.  No trash renters at the moment because if they get evicted, they will be basically homeless since so few rentals around here so all have been trouble free thus far.  Knock on wood.

By maing a place uninhabitable, it's called constructive eviction.  Better check with the state law.  Can the landlord retake the property for development?

In this case, I'd want to make it pasture land for cattle grazing (no human habitation) or sheep farming.

They damaged the sewer system, right?  Try to get some pics of their vehicles/stuff improperly parked on the septic system.  
If they take this to court, you want some evidence this is this their fault.

      Remove all exterior windows and doors and simply tell the state you are renovating.

      When I started "renovating" in February , house was empty in less than a week

Because he can only keep one trailer due to the newer dnr septic requirements for the new system.

So that makes it a 50 month payback with a trailer that won’t live that long. And new trailers combined with new septic will take even longer to pay back.

It doesn’t really matter about when they were there.

Missouri dnr I’m most cases won’t let you do anything to an existing basic septic system. They require a tear out and an installation of a modern perch system in different location on the property.

$20-30k depending on where you live.

You can usually do a holding tank with contracted pump-outs on a set schedule to buy time until the septic is fixed.
Like with a 1500 gallon septic, pumping it every week may suffice.

Check the local regulations.

Also check your lease regarding termination, ours says if the house is uninhabitable due to act of God, unforeseen circumstance, or necessary major repairs, they're terminated with no action against us. The county says its uninhabitable, they gotta go, so eviction is easy.

I would consider tearing down both shitty houses, and throw up one manufactured home.

My county considers a 10,000 square foot reserve area sufficient for one septic installation and two revisions, so the back yard of a 1/2 acre property.

Two systems on 3/4 acre would be extremely tight.

Sounds like this has been creeping up for a while, with you and your brother not lifting a finger about it.  Not like the mess with the septic is something you found out yesterday, right?  And being the landlords, you take the rent money, but fail to maintain the property in a liveable condition.  Now that the county is breathing down your neck, you want things quick and dirty.

Talk to a lawyer, especially if your brother is under a threat of violating some court order.  Start the court process to legally evict the tenants, and ask the court for an extension, until this is completed.  Check your own state laws about this.  In reality, as a landlord, you should’ve had them memorised already.  Do not do anything retarded, like lock them out or make their lives impossible, because this will be the tenant’s defense, and your eviction will get tossed.

Agreed, good idea saying that the tenants damaged the septic system in case they try to sue for some health related issue. Take them to civil court, it's not anything to be scared of. Two ways to go at it, if the lease is expired, you can kick them out for no lease and it's a little easier than trying to kick them out for non payment as the judge might give them time to pay, or they might file to determine how much rent is due.

You need to post a notice that the lease is expired and they need to move, the notices are diffferent from state to state and county to county, so probably get an attorney to help you with that as it gets the ball rolling on the eviction. Whatever you do, don't follow any of the suggestions about removing the doors, or fucking the place up trying to do a self help eviction.

I agree that they will ignore the notice, but it's a legally required step in starting an eviction process, post the notice and take gps and date stamped pictures of it on site.
