When you get hit from behind at a stop you are responsible if you hit the car if front of you.
What happens if your car slid sideways and hit a car beside you? Would the car that hit you be cat fault? |
|
The last person who rams everyone is 100% at fault. You are not negligent if your car gets rammed and hits someone else.
i did do a trial where I somehow threw aome liability on the middle car. The judge did mostly criminal stuff, not sure why the other lawyers didn't stop me. But this was decades ago |

I always hear to "leave a distance" though |

If it wasn't for that other person I wouldn't have hit it. What if somone rammed into a row of parked cars and mine was somewhere in the middle. I'd be at fault even though I was in a store at the time? How is that any different than if I was in a line at a stop light? |

Insurance appraiser/adjuster here.
This is how it will go down. 3 car wreck from rear to front car 1 car 2 car 3. Car 2 says I was hit from behind and was pushed into car 3. Adjuster asks car 3 did you feel 1 bump or 2? If car 3 answers I felt 1 bump car 1 is 100% at fault for everything. If car 3 says I felt 2 bumps car 2 is at fault some since they hit car 3 before car 1 hit car 2 AND car 3 is at fault some as well. Usually at this point car 1 and car 2's insurance have a gangbang and decides one of them will pay out for car 3 and will get some % reimbursed from the other insurance carrier. But the main determination will be made from the front cars answer to the question "how many bumps did you feel". |

Is that still the case in those huge pileups? If no one can figure out who was at fault for a cluster fuck like that all the insurance companies have a big ole gangbang and deny everyone else's claims and pay for their own insurers car, happens a lot especially if say two cars are backing out simultaneously from two opposing parking spots and back into each other, the insurance companies pay for their own insurers vehicle. Also in most of these instances if one car doesn't have collision coverage and any of the insurance companies believe that car is in any way even a little at fault well they are screwed. |
