How do we repeal 922(o) Technically automatics are the only guns totally banned by the government. |
They aren't banned but they haven't registered any new machineguns to individuals (non-ffl) since 1986. Which in essence is a defacto ban on new machineguns. |
No but that also haven't imported any more 91s, AUGs or FALs since 89 which is also a defacto ban. Which was kinda my point. |

Try the courts the 86 ban has not really been challenged in the courts. the stewart case was more about the extent of the comerse clause and the federal goverments power over the state and less about the consistutionality of the achine gun ban. Its thats question that we must ask(on a legal SC level) does 922(o) voilate the 2nd admendment? that questions has never been answred. |

922(o) was challenged in court and the courts initially said that the way the amendment was written it didn't stop people from making new machine guns. However it went to the circuit courts and was then lost. The machine gun ban has never been challenged in the Supreme Court. |
