It’s amazing to me what people will tolerate from their local law enforcement.

It was a legitimate cause 30 years ago.
Then the states kept lowering the BAC to be considered DUI. Like everything else, it just became a way to raise revenue. Am I surprised that people have been fucked over by The State? |

I represented a legal alien who was arrested for driving under the influence of drugs after a "drug recognition expert" claimed he "showed signs of being under the influence of drugs." He had to renew his student visa and was given a hard time over his DWI arrest. The test results came back negative eventually. He also had his car towed and he had to pay for that. I tried to talk him into suing but he refused.

I've known people who were arrested for DUI who deserved it, I know people who were stopped and arrested for completely BS reasons. I am by no means a proponent of DUI, especially with the ease of Uber/Lyft, and I cringe at the thought of my drinking and driving when I was younger.

I want to know what part of the field sobriety test are they failing?
Is it the Horizontal Gaze Nystagmus Test? There has to be a common denominator here. Also, What happens if you refuse a field sobriety test and you’re not impaired? Proven by blood test? |

According to the arrest affidavit, Gray had crossed the center line. A deputy wrote that Gray’s eyes were red and was slow to respond to questions. The driver hadn’t been drinking but two of us had so the cop definitely smelled alcohol. He made my buddy do a field sobriety test on the side of the road, in the dark, on black ice. After that he made my buddy do a breathalyzers. He blew 0.0 That wasn’t good enough and he had to do it all over again when a second cop stopped to help and used a different breathalyzer. |

From a brain injury in 2015 has caused balance issues and another injury in 2010 caused some issues with my leg/ ankle. |

Remember probable cause isn't that high of a bar to meet. As long as the officer documents his observations truthfully, it's how the system is build. |

several times local cops have sniffed at me while looking at my license and said "I think I smell a beer on your breath, Mr Scruff. I tell them No, not unless your nose goes back to 1981, you don't. Then I request a breathalyzer test. It must be a local tactic, it's never happened on road trips.

Having them blow zero, ringing up someone that the ADA will look at the case laugh, and dismiss/NP/however your jurisdiction calls it, is not the way forward. And in all of that time interviewing, arresting, driving to the station, processing, report writing...DUI Investigator Friendly could have found on that shift, an actual drunk (or three) that would make it to court. Look at your county's highest paid employees. Often, they're DUI guys. Because they're in court: All. The. Time. Testifying and related trial prep/conference time is not on their normal shift, and consequently overtime is over the moon. >99.5% accuracy doesn't sound that bad, tbh. Though obviously it sucks for Jane Doe who didn't do anything wrong. Do we want drunks off the road or not? Candy Lightner's subsequent disavowal of MADD notwithstanding. |

I wonder how much pressure is being applied to THP officers for DUI stats which could result in too many bad or unjustified arrests. You would like to think that officers would exercise good discretion in making arrests, but it seems like the law enforcement community in general is plagued with a lot more problems today than in years past. This is a very poor reflection of the THP as well as the state of TN.

Law enforcement is a very profitable endeavor for many people in our society. Law enforcement and the criminal justice system are necessary governmental functions, but consider there are a lot of politically connected rice bowls attached which affect their practical application. Without even discussing the giant fist on the political scale that are public employee unions. |

It remains in the vehicle all year round and can provide a false reading. Now the intoxilyzer machine, is a different instrument, which is usually stored at a facility in a climate controlled environment. Now what's challenged a lot in court for suppressing evidence collection is how the instrument is stored, maintained, and calibrated. IF there is any deviation throughout the log sheet, evidence can be suppressed. To your comment, the PBT can give false readings. However, the intoxilyzer is a more accurate tool. 100%, no. |

Are you complaining about the 600 people over 8 years that were found to be not under the influence being arrested? In ANY industry, getting your job right 99.4% of the time is fucking fantastic. In law enforcement, that's spectacular. I'm just struggling to see the outrage here. You were arrested, found innocent, no conviction means no loss of job/income/insurance. Is the act of the arrest and the time lost the problem? I mean, that does suck but again...only 00.6% of people are falling into that category...that's not egregious. |
