Backstory for anyone not familiar with the situation here in NJ. NICS has not picked up the phone since December and are requiring all dealers fax in NICS requests. It is taking two weeks on average for dealers to get a response.
I bought a M&P .40 a few weeks ago and it took 13 days for the NICS check to come back

IN Connecticut, we don't have any provision to allow for transfer after 3-days no-response, like federal law does. |
| I currently have 8 guns tied up in the Maryland backlog disaster. It is supposed to be a seven day wait and on the 8th day you get your gun. It is now taking 9 weeks. The law says the dealer can release the gun after 8 days but the MSP are threatening dealers who would do this. I have 2 guns that should be approved this week and I filed the papers on 3 more today. Maryland law states that if the dealer is not notified of the result of the state police background check within 7 days, then the gun can be transferred to the buyer. A local dealer has told me, however, that he was advised by Maryland State Police that if he transferred a firearm under those circumstances, his state firearms dealers license would be revoked. Like many LE agencies, the policies of the MSP bear no relation to the law. The dealer I referred to above has over 150 handguns that he has sold but is unable to deliver because of the slow response by the MSP, who are taking 6 to 8 weeks to complete a "7-day background check". |
