I know that an open bottle of liquor of a half gone 40 is considered an open container. Does this mean its technically illegal to transport an open bottle of liquor? If I have a half bottle and decide to go to a buddy's house to drink it, and get pulled over, am I violating that law? Same goes for a case of beer, say I have a 30 pack thats half gone and have that case in my car, is that an open container? Tryin to settle a little disagrement here

Technically the half-gone 40 is an open container, IF you keep it in your car in anywhere other than the trunk. If you don't have a trunk (SUV, wagon, minivan), I think it has to be in a locked container out of reach. As for the case, it is not considered an open container, since the beer isn't open to the air (it's still sealed in the bottle/can). |

Most people are aware an opened bottle of whiskey is an "open container." Less people are aware that a 12-Pack of bud, with two cans missing, is an "open container." |

I'm with you. With moderation in drinking as well as speed, going for a drive on rural country roads with a beer in hand used to be a favorite pastime of me and all my buddies. We called it "backroading." I mentioned this on the Detroit Free Press message boards once...you wouldn't believe the safety nazis that came out of the woodwork. Now the limit's .08. Who even has a buzz with .08 BAC??? |

| once while going to Niagara Falls to watch the Canadian Ballet there were 4 of us crammed into a toyota celica and 3 of us (the driver did not join us because we're fairly responsible) were passing a bottle of peppermint schnapps back and forth. we went across the border with it. Guess we're lucky they didn't look inside the car. |

The punishment for drinking a can of beer, while driving, is significantly more severe in my state than smoking a joint while driving. Alcohol violations are almost always more severe than marijuana violations. |

Besides, how would you know what effect a doobie would have?[shock] I was thinking about this at the bar tonight. i've revised my opinion it should be legal to drink/smoke/inject whatever the hell you want while driving if you screw up and kill someone because of it, you should be put to death it's up to the court to determine whether or not your substance use was a large enough factor in causing the crash to warrant death. example, drinking one beer while driving 25 and some kid jumps off of an overpass in front of your moving truck -- no time to stop. seems clear it would have happened beer or no beer--- no death penalty. drink 15 beers and crash into a van full of first graders, killing all of them, and you die. this way I could go drive down by the river late sunday night and legally have a beer while doing it. And drunk drivers would get executed. Sounds like fun to me. |

They didnt check me that time, I always got searched hard at the Peace bridge, never a problem at Rainbow bridge. |

I haven't been over the Peace Bridge in years, traffic is always backed up really bad, plus I've only been to canada once since 9/11, no need now that I'm 21 and the increased security isn't worth the hassle. We brought alcohol back a few times and never got caught.
