IIRC in the state of Indiana that is considered phone harassment and a verbal cease and desist upon notification to caller.  We don't have stringent recording laws, so as long as 1 person knows it's being recorded, you are GTG to record. YMMV

Are they using an automatic dialing system to call a cell phone?

If so, your wife is protected under the Telephone Consumer Protection Act.

http://www2.fcc.gov/cgb/policy/TCPA-Rules.pdf

$500 fine for each violation.

Found out last week I qualify for a class action suit against a debt collector.  This outfit purchases debts so old that the statute of limitation have expired on collecting the debt.

My ex-wife took out a bunch of credit cards, without my knowledge, over 10 years ago.

Link to my class action suit: http://www.prlog.org/11437412-florida-tcpa-class-action-lawsuit-filed-against-portfolio-recovery-associates-llc.html

You can also send a Cease and Desist letter, and Verification of Debt letter too.  Just google the terms and you should be able to find some good templates to use.

Go to creditboards.com and search there.  You'll find a wealth of information in dealing with these situations.
