Ok this is just a hypothetical question but i wanted to know what you guys think.

Say your 15 and you take a picture of yourself naked.  Now your over 21 and the picture is found in your possession (maybe in your house, not in your wallet).  Would you be guilty of child pornography?  Would you have to register as a sex offender for having a picture of yourself when you were underage?

And no i dont have pictures of myself naked, belong to NAMBLA or bumpfire guns underwater.  Just thought it would be a funny legal situation.  What do you think would happen?

But I have heard about asshat prosecutors trying to prosecute films of pictures of an infant's bathing, in the hands of the infant's parents.

... no, I don't think having pictures of yourself naked as a kid constitues child porn.

I'm sure my parents have pictures of me as a naked baby, but don't think that would be considered child pornography either.

No, there was a case a couple of months ago with an underage girl who had shared pictures of herself over the net being charged with distribution of child pornography. I'll try to find the details.

actually some over-zealous DA recently took a 16 year old girl to court on charges of possession and distribution of child pornography, because she was sending naked pictures of herself to some people online.

I read an article a couple months ago about a kid (14, IIRC) who was charged with having child-porn because he had nude pics of himself.   I'll see if I can dig up the article...

Okay, as a photographer, I likely know more on the subject:

Possession of nude photographs of minors is not illegal, with the permission of themselves and their parents. On a nude beach or nudist camp, permission for photography is generally only required by the owner or manager of the property; therefore, legally, you can snap photos of anyone there under the same rules as taking photos in public. If you're in public, you can take candid photos of anyone and they can't say anything about it. Generally, however, it's best to ask permission of the people you're photographing, you might have some awkward questions to answer first.

Any lewd or suggestive poses, angles, etc. count as pornography. Therefore, taking pictures of your daughter playing in the bathtub is legal; taking pictures of your son in questionable poses is not. Do a search on Jock Sturges, you should find some articles covering this topic. David Hamilton and and Sally Mann are other famous photographers you can research.

As for possessing nude photographs of yourself as a minor, it is legal. However, there was a case earlier this year where a 15-year old girl was convicted of child pornography charges for posting nude photos of herself on the internet. So it all depends on the intent of the photographer and the material in the photograph, which is fairly open to interpretation.

Long story short, you SHOULD be safe, but I wouldn't go flashing that photo around.

Yeah. Toeing the line between porno and simple nude photography seems to a hobby of hers.

I myself have no problem with nude pornography. God made the human body and it is nothing to be ashamed of.

It's when the human body is exploited, willingly or otherwise, that I start getting pissed.

This happened about 10 years ago and things may have changed since. A guy I know works in a film processing place where drug stores, dept stores etc send film in to get developed. He said that they had a guy that kept taking nude pics of his young children and wanted them developed. They refused and contacted the police and after an investigation concluded that it was legal because they where his kids. The guy kept sending film in and they just destroyed them when ever they came in.
He told me they didn't care about nude adults and saw so much of it they seldom bothered to look anymore. He said that he was surprised at how much of these pics (adult nudes) are sent to them for developing and after awhile seldom bothered more than a glance.
Sounds like a good job to me!!!!  LOL
