I have heard this on this site before, but I will ask it again. Can you build a Preban rifle from a parts kit? What if the Lower Receiver is a "Pre-Ban" and the Parts kit is "pre ban", is it legal then?

That would depend on whether or not the lower receiver is marked "Colt AR-15" and if not, whether or not you obtain it as a documented 922(v)(2) exempt, complete semiautomatic assault weapon or a stripped lower only.
