The threads speculating about Obama signing an executive order to impose tougher gun laws without using Congress has me wondering. Can the President really do that? Here is an example. Teddy Roosevelt pretty much set the precedent for EO during times when a certain breed of bird was vanishing and he'd sit down with his lawyers and other members of his staff and ask if he could declare it a sanctuary. They all said that yes, he had the authority to do it, and bam, he did it. I don't think his use of the EO was ever challenged. So to be more precise with my question. If the President tried to sign an EO limiting the capacity of magazines people can buy or something to that effect and we all know how lawyers have all kinds of different interpretations, as long as nobody legally challenged it through the courts, could he really succeed in doing that? Or would there be other legal issues with regards to political jurisdiction and such that would prevent EO from doing that? |
