My wife has a friend whose husband recently got into meth and racked up quite a bit of credit card debt ( into many 1000s ) under his name only as far as I know. I believe he just recently opened these cards as well, I don't think they were old cards that both parties had been using for awhile if that makes a difference.

Couple days ago he beat her near senseless and is currently in jail for the domestic violence ( hasn't been charged with drugs, i don't think )

I guess he plead guilty as he was sentenced to 30 days, and 1 yr probation. Has to abstain from booze or drugs and will be monitored. Sounds like he is not allowed contact with his wife/kids and cannot go home after his 30 days.

My question is, does anyone know if she is liable for the debt he racked up in the last month to get drug cash or no ? If she is not liable, would she have to divorce him in order to avoid liability ? Don't know if she plans that or not.

I imagine it might vary by state, just curious if anyone knew anything. It doesn't affect me personally so don't take it too serious, just got me wondering.

I slept at a Holiday Inn once, and actually hired a lawyer last year, so I'll give you my non-professional opinion:

Unless they have a pre-nup separating their responsibilities, she is likely to be responsible–– EVEN if she divorces him.

Tell her to lawyer up, NOW. Right now. Don't wait till tomorrow. Start getting lawyer recommendations right now.

It would probably vary by state. Here in Montana ALL mairtal debt is 50/50
