So, I purchased a firearm off gunbroker, a Glock 21. The seller emailed me saying he would send it from his ffl to mine. It arrives at my ffl on Friday, but no ffl with it. My dealer said he can't release it to me without it. I have purchased about a dozen guns over the internet and used this dealer for all of them without a problem. I email the guy asking for the phone number of his ffl holder so he could fax it to mine. He replies by saying that "you don't have to be a ffl holder to send a firearm". He said his dealer told him it wasn't federal law and my dealer was the only one that had to have it. So I call my dealer this morning and ask him, he tells me that since the gun is already their he will transfer but the guy needs to fax a copy of his ID. I know some dealers won't do transfers without the sender having a ffl and some will.

Does the sender of the firearm have to show ID?

He said if the guy doesn't fax it he will Return To Sender.

Any information would be appreciated.

NONLICENSEE STATE-TO-STATE TRANSFER

ATF has received questions regarding how a nonlicensee may handle the transfer of a firearm to another nonlicensee residing in a different State. Regulation 27 CFR 478.30 does not allow a nonlicensee to transfer, sell, or deliver a firearm to another nonlicensee who does not reside in the same State. However, per 27 CFR 478.147, a nonlicensee may directly ship a firearm to a licensed importer, licensed manufacturer, or licensed dealer for any lawful purpose. As such, the nonlicensee may arrange to ship the firearm directly to a licensed dealer in the State where the other nonlicensee lives. The receiving licensee is required to enter the name and address of the nonlicensee from whom the firearm was received. A copy of the nonlicensee’s driver’s license may be used to verify this information, but there is no regulatory requirement that it be provided by the nonlicensee. Afterwards, the nonlicensee who is to receive the firearm would be required to complete ATF Form 4473 and be subject to a background check. Also, any corresponding State requirements would apply, such as a waiting period.

So it's just my dealer that will not do the transfer without ID. It's not the law.

It seems a lot of dealers want an ID copy for transfers.  I think part of it might be people using the UPS store places.  If they do that the box has their name on it and the stores address.

The problem is your dealer has to log that firearm in his books. He has to show in that entry who sent him that gun or who he bought it off of, etc.  An example would be the gun was received from Bobs Gun Shop or from Billy Bob Jones, or Some Big name distributor. Unless he a copy of an FFL or some type of information he's stuck. He just cant let you fill out the form and walk out the door because he cant verify to the agent doing his inspection where this gun came from unless he makes something up. The person who sold you this firearm should not be such a dickweed and give you and the dealer the info.
