Damn, that video is old.  I still have a problem with him shooting around the little girl, but it ended up as a good shoot, so who am I to question him?  I probably would have tried for a better angle first, but to this day, I still love how he used the fat chick for cover to draw his gun without a commotion!

No legal trouble for shooting the robber as he fled?  Don't get me wrong, I don't have a problem with it... if you decide to try a stunt like that, as far as I'm concerned you've forfeited your life.  But our overlords tend to take a dim view of that sort of thing.

How the heck are you people judging a 'clean line of fire' from a 2D video of a 3D space?  Personally I'm going to trust the shooter saw he had a clean line of fire and took it.

No babies were hurt, but the bag guy was.  Guess the shooter knew what he was doing.

dupe...a good one though; i heard that the shooter was hasseled later on by the DA/courts about the shoot (or was it another incident i'm thinking of?) and it cost him some hellacious lawyer fees (no charges though)

any one remember this?

Well, hearing damage is plausible since the guy shoot 3 times at 1.5 - 2 feet from her face plus the closed enviroment amplifies the blast!!! Next time the mother have to make sure her child wears ear muffs all time...........It's for the children

Ok, I have a question here. How does that work? If the individual is fleeing, with no weapon (that I saw), is it justifiable? I'm pretty sure it's not for personal protection, but what were you saying about protecting the money and its relevance to the shoot? If it is different, does that say anything to anyone? I'm not saying that I personally think it was a bad shoot, the bastard deserved it. Just wondering in regards to the law, etc, as I'm armed security and a CCW. Thanks in advance, guys.

In Ohio, CCW stipulates no shooting to preserve your property, and many, many more restrictions.

Never figured out the ability to shoot to save money, give the restrictions on a CCW and misc State law in general regarding armed nonLEO individuals to include business owners on premises.

Maybe a good lawyer and a sympathetic prosecutor help.

I work for a security company and between state law and company rules, the weapon is an ornament, good for higher pay but little else.

Even removing it from your holster can lead to serious ramifications, let alone having to use it.

Big bummer is not being able to work while a grand jury reviews, doubleplusbad if you get charged.

Also open to civil suits, company may or may not choose to defend; you might be on your own.  The slightest variation from state law and company rules gives them the right to wash their hands and leave you on your own.

The bad guy still had his gun out.  You have to articulate that you were in a continuing state of danger because the perpetrator was moving to a position of tactical advantage (cover) from where he could continue to shoot at you.

About the best argument you could think, but unless he was turning back towards the store, I would think it would have been a rough day in court. Just from what I can say. Not saying I wouldn't have LIKED to have done the same thing...


There are situations where this is justifiable, as you can defend yourself from perceived threats.  You do not need a “right-now,” direct threat of someone pointing a gun at you before you act – or continue to shoot.  In this case, the bad guy moving away does not end the gun fight or the threat.

If he's running away towards cover, you can shoot him before he reaches it.  Otherwise, he can pop off shots at you, at his leisure, while you're out in open space...  Not good.
