It would appear to be all legit, but wanted to see if there was any dissenting legal opinion or clarification from the BATFE on this.

Would it be legal for me to possess and install a 10.5" Simunition upper on my AR lower?

I just want to make sure my ass is covered and don't get dinged for constructove possession or some such BS.  I know, as we all do, that the Simunition upper does make the lower a complete firearm, but logic seems to have escaped the BATFE.

Assuming your lower is not either a full-auto RR, or registered as an SBR, it would NOT be legal for you to possess or install a 10.5" upper on your rifle.  A Simunition upper is no different from a .223 upper for the purposes of the law.
