Two Cited For Making Snow Phallus

May 1, 2005 9:13 am US/Pacific

LARAMIE, WYO (AP) Two men have pleaded not guilty to promoting obscenity for allegedly building a snow phallus in their front yard.

Brandon Arp, 20, and Aric Davenport, 19, were arraigned Friday in circuit court.

Police say Arp and Davenport built the sculpture April 21. Neighbors found the sculpture offensive and, although someone destroyed it, the two were cited.

Davenport's attorney, Michael Vang, said it's not clear how the sculpture was obscene. He accused police of selective enforcement.

How could they be cited if the evidence was destroyed?

If the item was destoryed, then how could the evidence posssibly stand up in court?

Yes, without hard evidence it will be difficult for city attorney the to erect a case.

Reminds me of the time in Germany when we made a snow  “phallus” on top of the barracks roof. It could be seen by all as you entered the German village our post was situated next to.

I suppose the 'anatomically correct' snowman my friends built last year was bad, then?

Sounds like a hard case for the city to win.

They could be in-and-out of court for a while before this is discharged, but they are young so it could be over quickly.

I'm sorry, but if just the existance of a phallus is obscene, then Michaelangelo's David is obscene too.  Even moreso, since it it an entire naked body rather than just the phallus.

If they had built a snow sculpture of an 8-year-old boy blowing a donkey, then that might be considered obscene.  Just a phallus, no way.  I'd fight it in court.

It wasn't a phallus.  It was a snow sculpture of a tall mosque with two much shorter mosques flanking it.

Freedom of religion.    Call the ACLU and sue the police and the neighbors!

If there had been any evidence,  I think it would have melted in court!
