I recently got my VA Disability approved after a lengthy wait and appointment after appointment. I do not want to reveal too much OPSEC and all. I got the back pay and that was a nice suprise! I was wondering why sleep apnea is awarded at 50% but other more debilitating injuries rate for so little? I mean I gotta use a CPAP big freaking deal, but can't run or walk long distances due to leg and back injuries and can't hear shit! Whats the deal with the rating scheme? I don't think that the CPAP is all that big a deal but if I cant hold down a job due to not being able to stand or walk around all day in my chsen profession, then why does that rate less? Shouldn't injuries rate more than sleep apnea?

I was wondering why sleep apnea rates more than injuries incurred while on active duty.When I got my approval in the VA was asking that I provide them some more information concerning my dependents so I brought the documents into the local VA. While he was processing my file, I asked my VA counselor and all he said was that it was just the way it works. He didnt really satisfy my question but I didnt want to press further since there were several dozen people waithing to speak with him.

Sleep apnea has serious side effects upon the body, the VA isn't just compensating you for lugging a CPAP around for the rest of your life (but lugging a large medical device, finding distilled water whereever you go, etc, are a big impact on your life).

YES it does. I know a guy who was hit with rock debris when an RPG went off near him. A rock cut his neck. He was awarded a Purple Heart AND 70% Disability. The fucker owns his own construction company and builds houses.

Both. There are millions collecting VA disability benefits who shouldn't, who know they shouldn't. There are millions collecting VA disability who have very little to no service related issues.



They served, they deserve the entitlements they were promised, but for many that just isn't enough.



The system is fucked, it is geared to aid those who want to abuse the system, and not to make sure that the honest guys get what they have coming, this makes sure that people whose only disability is their being lazy as hell get paid, while those who are truly disabled have to wait for years before they get what is owed.



Yes, I served, no I don't collect anything, no I don't deserve to collect anything, I came out of the Army healthy. Sure, I spent three years on jump status, and now as I approach my forties my knees are starting to act up, as are my ankles, but that is because I am pushing forty and have used and abused my body my entire life, not because I was in the Army for four years.

There are examples of both.  I had medics telling me how to game the VA system when I was getting out of the Army.

I probably could have gotten some disability as my ears ring sometimes, but whatever.  I had a class with a guy who gets $1300 a month in VA disability because he never wore earpro when he worked on the flight line so naturally he got tinnitus.

All of our wounded warriors at my place of employment got injured in united states (car wrecks, fell at home,.....etc). Not a single one in combat.

I am 6'3"and weigh 235lbs hardly overweight! I have had the snoring issue as long as I can remember. Wife says the CPAP has helped her sleep too! Do not be so fast to judge without knowing the facts! Have had a couple of really bad injuries on active duty that got me pulled from jump status. Also got tagged with a flash bang that ruptured my eardrums.

Was a dumb young kid when I got off active duty in 1995 and waited till 2010 to claim since I have been reserves off and on active duty several times since 2001. The multiple deployments have aggrevated my back and knee probems.My last deployment I was talking to a friend who is an M.D. and asked why all of a sudden I was having very bad memory problems and couldnt seem to be coherent till mid morning, and other issues. He asked if I snored and told him my wife says I do. He suggested it could be sleep apnea and schedule an appointment with my primary physician and request a sleep study.

Long story short I was diagnosed with severe sleep apnea and required a CPAP. Like a good soldier I turned in all my medical records and let the VA make the judgement.

VA disability rating is relative to the doc doing the exam.

A friend of mine was rated WAY up for cold exposure due to his time in Alaska...yet I spent way more time there than he did and only have 10% for a back injury.

Don't get me wrong...I'm not wanting more than what I have. It's just that the system is seriously flawed and people are getting way more than they deserve based on what doc did their exam.

I was an infantryman and boxing for the USMC. I had a documented head injury and suffered seizures afterward.
The Navy (who handles the medical side) tried saying it was my boxing that aggravated the injury I suffered in the field and the real cause.
My unit tried to get me an admin billet, but the Corps had a policy of every Marine had to be deployable.

It killed my Marine Corps career, killed my boxing future and any potential future in law enforcement.
I was on medication for 5 years and unable to get a driver's license.
My disability rating is 10%, the Dept of the Navy didn't even want to give me that, my unit had me go as high as the Commandant to try to stay in, the compromise was 10%..

That didn't even cover bus fare when I first got out and the rating was so low that the VA wouldn't even cover my meds.

I never wanted to leave the Corps, I would have done anything to stay in. If I had a problem like sleep apnea I damn sure never would have gone to sick bay.

Here's my story....3 herniated cervical discs in the neck (c4,5,6) that are from 11 years and 1836 hrs flying/instructing in the Viper.  Looking over your shoulder and pulling 9Gs with a 3 or 4 lb helmet while taking notes on your dumbass student trying to gun you is not good for the spine.....no shit.  They want to fuse my vertebrae....  no thanks, inversion works miracles once a month.



blew my knee (ACL, MCL, 80% miniscus) playing AF softball at DM AFB learning to fly the A-10.  Never went to the hospital until after A-10 RTU... diagnosis, bad.  ACL reconstruction and 4 scopes (arthroscopic surgerys) later.  have a permanent limp!  Severe arthritus in right shoulder, torn labrum in left shoulder( all resulting in being told to lift  heavy weights to tolerate Gforces....plus i love to lift!!!!!!!, hearing loss in both ears is significant.  




Result is 60% and they asked if i snored....I said of course...who doesnt?  They say...we could get you to full disability.  I said....you're fucking kidding me!  NO FUCKING THANKS...THATS WHATS WRONG WITH THE COUNTRY NOW!  I can deal with the snoring.   I  have no problems sleeping, dont want this BS.  I am not a fat slob but my nose has been broke 5 times since high school!  Sure...give me more free taxpayer money....is say bullshit.




So I am at a total of 60% for some major bodily damage all caused by Serving related duties.  The apnea crap i think is a damn shame!




FLAME AWAY!!!!!  I could care less nowadays!

The ratings all come from the VA Schedule for Rating Disabilities. Here, take a look at it:

http://www.benefits.va.gov/warms/bookc.asp

Compare the rating schedule to what's written in your decision, and you'll see how they arrived at your percentage. You might even be able to see where you could possibly have qualified for a higher rating and appeal it. That's what I did and got bumped from 40% to 60%.
