So today the wife was driving home after lunch, I saw her pass by me while I was at the gas station on our street. I turn onto the road and see cars stopping with 2 silver ones in the front of the pack, one of them being her's. She had our 17 month old in the car with her and herself luckily neither were injured.

Speed limit is 35, and she is pretty good about keeping the speed limit, always telling me how she hopes I get pulled over since I feel I'm above the law by going 10MPH over the limit . She said the car in front of her didn't have the signal on but was stopped in the middle of the road, she hit the brakes and had a nice skid mark I'd say about 20 feet. Said everything locked up and she couldn't swerve since there was no traffic coming onwards. No airbag deployment, but her knees are a little sore. I got out and checked on my wife and the lady in the other car started claiming how her neck and back were starting to tighten up yet she was fine moments before. Wife got a ticket for following too closely which is legitimate, but thankfully no one needed a stretcher or any other major injuries.

2003 stratus, more than likely getting totaled out now.

Yup thanks. Luckily her mom just retired and doesn't need her car for much since her dad drives her around like miss daisy , so she'll be borrowing her car temporarily. Coulda been a whole lot worse, plus she's been nagging about a new car so she just got her wish in a sense heh.

First I'm glad there's no serious injury to her.

Second, the second car stopped with no lights?  So, did it stop and then its driver lifted his/her foot from the brake or did it stop without lights, raising the issue that it had no tail lights?  Second, if the person just stopped to invite a collision, it could well be the other driver's fault.  My brother had this happen on a state hwy.  Woman driver ahead of him suddenly stops her car to converse with the driver of the oncoming vehicle.  At least she had to pay for that one and not my brother.

They were stopped, foot on the brake, according to my wife, no blinker though and no oncoming traffic. They were turning into their driveway off the main road, so I don't see it as intentional. The other car had no damage whatsoever, built Lincoln tough .

Wife came up and the car was stopped from my understanding. Shook up memories are t always the best to go off of in my experience

Aw, don't feel bad for the insurance company. You're gonna get boned on your inevitable premium increase.

Following too closely has to be the #1 cause of accidents. Unless it's following too closely while dicking around on your phone. Glad your family and the other lady are ok.

Buff like a mofo, but it is still a goner. It is dead Jim. If newer I imagine that the insurance company may fix it but not a 2003.

Gonna be calling insurance tomorrow. It's out of a slight curve, but not blind. Roads were slick from rain so it helped play a little part added to her possibly freaking out and applying brakes too hard from what I imagine.

There are 15 million new cars in the US every year.  They make more every day.  Wives and kids don't come that easily.

Discovery will reflect that, your insurance will pay for her year of chiropractor, physical thearapy. and most importantly,
pain management, then settle out for between 60 t0 80k. Plaintiff counsel will get 40 percent, making up to 80 as profit,
boheave FSA will get the remainder, buy her children ATVs (but no helmets), buy a new Chevy Cavalier ( or what ever piece of shit econo / swank to the unwashed masses entry level  vehicle GM makes theses days), throw a big shindigg for her friends and relatives in celebration, where at, one of her spawn will wreck their ATV into a gas meter suffering second degree burns on over ten percent of their body, whereby, they will sue the ATV manufacturer, the gas company and the trailer park owner
for not stopping them from riding the ATV on his property

Because the other car was stopped in the lane to make what b sounds like an otherwise legal turn, even if the blinker wasn't on that doesn't matter in this case. Lack of the blinker wasn't what caused the accident.

Bottom line, this other person got rear ended and only in very rare circumstances is the person who did the rear ending no at fault.

To add insult to injury, and I'm not trying to be a jerk, and I'm glad all are OK, but careless driving is a better fit it sounds like than following in that instance, so she prolly got a little help from the officer.

ETA. To explain a bit more, following too closely really just applies when both cars are still moving forward and the car in front stops short for whatever reason and the car behind can't stop in time

In this instance it sounds like the car in front was completely stopped and the OP'S wife noticed it and then jamed the brakes.   Kinda splitting a hair bit we would usually write following even though careless would be a better fit. This would depend on the driver too if they were decent or not.

Ultimately, the charge Didn't matter as long as there was someone ticketed at fault and following wasn't as serious as careless so non reason to jam them up more than what was required.

Sadly we have become a world of sue happy folks, but I'm banking on them not being the type. Could be wrong going off my precious vegas trips , but it's a gamble you have to take every day you leave the basement.

I'm sure every state is different, but in Michigan if you rear end someone you are at fault. Doesn't matter if they are turning or had their turn signal on/off. Even if someone slams on their brakes you are responsible for maintaining a safe distance between you and the car in front of you. The only exception is if the car in front doesn't have lights and it's at night.

That being said accidents happen. No one's perfect.

Exact same thing happened to me in my five month old car.  Airbags deployed.
Road was wet, I didn't see brake lights.

The thing that saved me financially was the other driver had no insurance, and had questionable citizenship.
I paid the ticket for following too closely and my deductable.
My car got fixed, and that was the last I heard of it.
I never heard a peep from the other driver.
