so if i bought a stripped lower can i use it as a lower to build a pistol on?

What is bogus? If the lower left the factory as a *stripped receiver it can be used as a pistol. The first 2 responses were not correct.

*Depending what your FFL list the lower as, mine listed it as a stripped lower receiver. It also must not have a buttstock installed from the factory.

And, since the lower is neither a pistol nor a rifle in stripped condition, it should have been 4473'ed as "OTHER".

You can use it as a pistol lower only if it wasn't built up as a rifle at any time.

I AM NOT A LAWYER !!!

If the lower was a rifle first then NO. If the dealer filled out "rifle" on the 4473 when the lower was transferred even if it was never assembled as rifle, then NO again.

Not trying to be rude or anything but the feds do not mess around when it comes to stuff like this.

When I purchased my lowers the FFL dealer had me fill out the same form as if I were buying a pistol. The guys above seem to diagree.. To be safe ask your dealer. He should know the procedure

All STRIPPED lowers should have been sold as other. If they did not they either you told them different.. OR they messed up.

A stripped lower that has never been assembled as a firearm is not a pistol, its an "Other" for Federal purposes.  That does mean that it is not eligible for purchase from an FFL by someone under 21, similar to a pistol and may be why either you or your FFL is confused.

Any lower that did not have a greater that 16 inch barrel and a buttstock installed on it first may be built into a pistol. If it only had a 16 inch upper but no stock you can still make it a pistol no upper but had a stock, it can be a pistol.

A lower DOES NOT become a rifle until it has BOTH a stock and an upper. That is why lowers that have no uppers (even ones with a stock) are transferred as other on the 4473.

Also due to a recent ruling from the ATF If something is a pistol it way be changed to a rifle configuration and then back to a pistol without breaking the law. However you need to make sure that you do not create an illegal sbr in the process. Meaning remove the stock before putting an upper with a less than 16 inch barrel on it and have a 16 in or greater barrel or no upper on before putting the stock back on.

Ad since it is NOT  long gun, you must be 21 to purchase it from an FFL.

The purchase of ANY firearm from an FFL by someone under 21 is limited to long guns.

An 'other' is NOT a long gun.
