Ok, so heres the deal, i tweaked the shit out of my knee a few weeks ago at work, and it hurt like hell but i sucked it up for a couple weeks (though i did do an injury report). Well, i went hiking with some friends saturday and boy does that shit hurt now, same hurt, i didnt injure anything on the hike.
I'm planning on going to a doctor tomorrow any my question is, do you guys think i'm gonna get fucked by the workers comp/city insurance people cuz i didnt come in sooner? |

CYA See, I did report the injury, I just told my supervisor I'd take it easy and didn't need to go to the doc at the time, and he okayed it. He could have ordered me to the doc but he didn't, and by not going I didn't give up my rights to get it checked out later. |

If you don't go straight to the doc here when the injury occurs they will refuse to cover it. |

The state will get involved. They do with any worker's comp case, the dept (town/city/county) is required to report it. They'll send you letters for months all but begging you to file claims, even if the dept already took care of everything.
I've been injured twice on the job. If you were negligent (especially if the bills are high) and your negligence was a contributing factor, expect the worker's comp board to refuse to pay. Or to refuse to CONTINUE to pay. They agreed to eat what they'd already covered for me (the expensive shit), and left me with the physical therapy. |
| At my agency you'd be fine. You reported it the day it happened, and gave it time to try to heal without seeing a dr. I'd just tell the dr straight up what happened and when it happened, and that you were trying to see if it would heal on it's on (which you were). Workers comp should cover that. |

I basically want to be able to return to work and have my OTJ injury taken care of, hell, if i made it worse by hiking i'll throw in a percentage, but the point of the exercise is that i wouldnt have made anything worse if i hadn't been injured OTJ previously. |

Keep copies of everything and scout out a good workman's comp atty. It may not be the agency screwing you, but the company that handles W/C insurance. Which in his case is PROBABLY Virginia Municipal League. They handle a huge number of cities and towns in Virginia. Most counties are insured by VACO Virginia Association of Counties. VML is very easy to deal with, unlike the state side of things. |

Take care of it; knee injuries are nothing to screw with. |

Trust me when I say to get a good attorney to make sure you are taken care of. I've had two injuries/three surgeries over the last four or five years. Our newest sheriff acts as if it is something personal and we're taking money out of his pocket when we get hurt and turn it into worker's comp. Fortunately, I've never paid a cent other than for after-surgery meds, crutches, etc. but got reimbursed for everything, including about 2k miles that I put on for doctor and therapy appointments.
Before this career is over with, I am going to end up with new knees (one tear from an academy injury that I never had taken care of 17 years ago and the latest that has had two surgeries on it from getting kicked in the side of my knee by a prone psycho). I am reminded of it every other day when I go for a run. Good luck getting back in the best of shape. |

Do it right and heal properly or you will be hating yourself in 20 years. 8 weeks of desk work is a small price to pay for having a knee that works properly. No cheating and pushing the injury before it has healed properly, either! Rest means rest, your body needs the time. You will be back in the saddle soon enough. |
