Victorious battle, but I remain dubious over the outcome of the war...

Both this and Heller are a rousing defeat in my eyes, as evidence that the system is officially broken and riddled with incompetance. When the best you can do is a 5-4 majority on an issue as clear and fundamental as "is water wet", then there is reason to be alarmed and disgusted. Reading over the dissent's so-called reasoning that Heller was wrong, that the minority does not believe this applies sickens me. A 5-4 victory is anything but... it's a pause for a few years until the situation arises for another such case with a different panel of SCOTUS Justices.

I apoligize for being Debbi Downer to those of you who were really looking forward to the good news, but a second 5-4 and its ramifications remains the turd in my punchbowl at the party.

Looks llike a step in the right direction but it seems to be a small baby step.  It sounds like there are a lot of unanswered questions moving forward and given the political climate in the cities in question I doubt that this is over just yet.

There are lots of questions to be answered but at a fundamental level this says that a city or state cannot deny ownership of a handgun in the home for self defense.  What is fully meant by the 2nd amendment applying across the board is still to be sorted out.  I doubt it will extend much past the basics for awhile.

I was disappointed in the ruling being 5-4 as well.  Particularly the bit where precedence was challenged by saying Heller was flawed.  We've ended up with a deeply divided system of confrontation in all branches of government and it's gone on for so long that it's now represented in the Supreme Court.  It's always liberals versus conservatives and Democrats versus Republicans without much quality governance as a result.  The court reflects this divide and is diminished by it.  In this case the minority said we were obviating the role of state and local elected officials by making gun law a matter of federal concern.  I doubt they would take that position if another amendment were under consideration.  Could a local jurisdiction deny women the vote?  There will be more fights later.  It would be nice if we could have a sweeping decision but it looks like we have to do this staircase one step at a time.

Still.. enjoy.  This really is an important victory.

5-4 again? That really bothers me. I know it has laready been said a few times but this really does seem cut and dried so I am concerned that the court will turn with a few more new judges and reverse itself quickly.

However I will take the victory.

YEAH, the 5-4 ruling worries me too, but this case sets a couple of precedents.  the most notable in my opinion being, that the 2nd was interpreted to mean that each individual citizen has the right, not just the populous as  whole.  that is pretty important to me.

Don't be proud. They didn't lift the ban, it was sent back to a lower court to be reconsidered. Chicago is still gonna put in the most restrictive BS on the books and make you jump through hoops and shell out dough as well as personal info. Chicago still sucks.
