I'm 20 years old and recently bought a new G21 " PICS to Follow" through a private sale. I decided to buy an Uncle Mikes sidekick yesterday and now want to open carry, I live in WV and know it is fine to do so but what I do not know is laws about carrying in my car.



any takers??? I tried packing.org and got nothing so I figured someone here might know.

I don't think it was legal for anyone to sell a handgun to you since you are under 21. I also think you are in violation for purchasing it while under the age of 21.

Am I wrong? Anyone know for sure?

Yes you are, I cant buy a handgun from an FFL dealer being I am under 21 and FFL dealers are regulated by federal law and the ATF but under sate and federal law the ATF can not regulate private sales making it totally legal for anyone 18 and above to buy a handgun.

Open carry is not illegal in WV.

In a vehicle it must be visible and it must not be configured for hunting.

Its not illegal to posses a handgun under 21, it is however illegal to purchase one.

If I were you, I wouldn't open carry until you turned 21, you're just asking for trouble if some COP decides to ID you.

In some states, yes. Under federal law, incorrect when dealing with private transactions. Federal prohibitions on sales to those under 21 pertain only to FFL dealers.

When in doubt, ask a lawyer. This costs money, but it's the best way. Make sure you get an answer in writing.

If you're not sure now, wait until you try having this discussion with a Trooper, an attorney, a DNR officer, a magistrate, and few guys from the gun store. All you'll be is more unsure.

Here is the WV Code. The sections you need to focus on are Chapter 20 "Natural Resources"  specificaly 20-2-5(9). If you don't have a headache after reading that one check Chapter 61 "Crimes and Punishment" specifically 61-7-3.

Also check the State Police FAQ which is somewhat cotradictory itself.

I too am 20 years old, and would like to open carry.  But since it seems that the general population has been brainwashed into believing that you have to be 21 to have a handgun I choose not to carry to avoid the hassle.  The last thing I want is to have to deal with a uneducated cop and wind up arrested and or lose my gun.

So unless i'm hunting or heading to the range i don't carry.  Its only 1 more year till we're 21.

That's too bad.  If an LEO is not well informed on this issue, you'd do him a favor by educating him and possibly saving someone else the hassle of going through the same thing.

I know but I just dropped $600 for the G21 so I'm kind of low on cash right now, I picked it up at the local FFL for $20 so it will do for now. I've decided not to open carry, it seems like a big hassel, the cops around here are all cool but there is one-two that have a bad rep. I'll just wait for the big 21 and the CCW before I pack, thanks for the input on everything guys, I'll get some pics up ASAP.
