| Dude, silencers/suppressors have always been legal on pistols. You just couldn't install them on your AR, because BATF categorizes a silencer/suppressor as a flash hider and counts it as one of the "evil features". They are/have been/probably always will be subject to NFA registry. |

paying a tax stamp is not needed. First check and see if your state and local laws allow for them. Now here is the real slick thing. A trust can own anything, class 3 , NFA, SBR's etc... no tax stamp required. no back ground check everytime you buy something. Have a lawyer draw up a trust, Fill out a form 4 with the BATFE . 6 month later or so and you'll be in business. |
| I have heard if you buy a NFA item (silencer, MG, DD) using a trust or corporation you have to pay tax on the value of the item yearly because it is concidered an asset of the trust or corporation. If you do not the IRS will be talking to the CEO (you). Is this true? Also the lawyers fees will be expencive and depending on where you live will caust you more than the $200 tax stamp. |
Pathfinder74, please note that "subject to NFA registry", includes the submisson of all required paperwork (BATF Form 4, fingerprint cards, Cleo signature), as well as the applicable $200 transfer tax. |

Not to be a dick but just for your info it is NOT a "Silencer"...It is a SUPRESSOR, because the only "silencer" available is made up in Hollywood.....nothing eliminates sound completely....to my knowledge otherwise someone correct me so that I can feel like a jack-ass. |

Some sound suppressors are so good I would go so far as to call them silencers (.22lrs for example) some have signatures quieter than pellet guns, if I can shoot it in one room and no one hears it in the next room, believe me it may as well be silent. By the way, Hiram Maxim invented them and he named them silencers, so technically I think the name is accurate, even though there are individuals like Al Paulson who think of other terms. If he had called them do-dads that would be accurate also. |

Trusts and corporations don't need CLEO sign-off, but still need to fill out a form 4 and wait for the paperwork to clear. I get sick of the whole argument between "silencer" and "sound suppressor" it's like someone complaining about a "cartridge" being called a "round" or a "magazine" being called a "clip." Sure, there are differences, but I think most people posting on a specialized forum like this know the difference. FYI, when I filled out my form-4 for my "sound suppressor" the dealer specified that the ATF wants "silencer" written on it, not "suppresor" or "sound suppressor" because the clerks know what a "silencer is" but not always what a "suppressor" is. I don't know about you, but if I were that ignorant of the nomenclature involved in my own line of work, I think I'd be in trouble. |

I'm pretty sure you can thank Hollywood for how silencers and their uses are perceived... in case you didn't know... only assassins and hitmen use them. It is about the stupidest law ever enacted... ok, maybe not THE stupidest, but it's damned close. I agree with you and maybe you should ask OHSA instead of the shithouse lawyers in here... they could probably either give you the definitive answer or take you recommendation to the next level. It would more than likely get shot down because it makes entirely too much sense... the .gov would rather pay the millions of people getting out of the .mil for hearing loss when they apply for VA compensation.
