Since I wasn't yet an AR guy during the ban era, I have a question about it. Basically, the government banned the sale of "assult rifles" to civilians. So, hypothetically, if we were to see this again after November, however unlikely, how would it apply to builds? If I picked up a couple of lowers, would uppers be legal and available to purchase? thanks for putting up with the rookie question.

At this point, any answer is nothing more than a WAG.

Under the 1994 law guns that were already in the applicable configuration were "grandfathered" in.  You could not build a new assault weapon even if you had a pre ban receiver in the bottom of your safe.  Some of the same questions we hear today ie "how will they know?" were heard then.

Any new law will need to take into consideration that there a lot of guns and magazines out there that have restrictions stamped into them about military and le use only.  Those guns are perfectly legal now.  If there is a new law, how are we going to mark the newly restricted guns.  I guess they could just eliminate any grandfathering and just confiscate everything.

Well, you have no idea how a new ban would work till they pass a bill.

For example HR 308 by Rep. Carolyn McCarthy [D-NY4] is a bill to try and bring back the high cap magazine ban. In the bill their is wording to state that not only will civilians will not be allowed to BUY new magazines after the bill passes. Anything you currently own would be legal. The bill also has language that shows how they would know.... Any magazine manufactured after the date the bill would become law would have to be marked in some manner that identifies it as made after the ban. So, your magazine made the day before the ban might say nothing, the day after the ban might have "banned for civilian use" or some other term marked on it.

How could they track a post ban assault weapon? Same thing. They could just mark the new receivers Mil/LEO and thats all she wrote.

BTW HR 308 has less than a 3% chance of passing based on:
   The sponsor is a member of the minority party. (-2%)
   A cosponsor in the minority party has a high leadership score. (+3%)
   A cosponsor is the ranking member of a committee to which the bill has been referred. (+9%)
   Just 4% of all House bills in 2009–2010 were enacted.

But it does have 111 co-sponsors, all democrats not a single republican.
