| If I form a trust or LLC this is a legal way to possess a AOW in NY and not have to have the CLEO sign off on it, correct? If I'm wrong please correct me. |

Head over to the NFA forum for this question would be my best suggestion, but the way I understand it, yes it is an acceptable means to do so, however I think that in the case of a Serbu it would have to go on your PP, which would leave it open to administrative approval by your local Judge. Thats just my guess, I know we have some guys on here that have gone through the whole deal. |

I'm guessing that my CLEO would sign off on it but I definitely want to find out if it goes on your pistol permit or not. |

That is correct in all aspects. It can be done through a CLEO, a trust or an LLC. And it has to go on a valid NYS pistol permit. The real question is, who is going to do the class III transfer for you? Me. I'm getting my SOT in July. So you'll be able to do transfers aswell? I need a good Class III Transfer person. Where abouts in NY are ya? |

I'm working on finding a store front right now but it will be somewhere between Livonia and Dansville. |

Does anyone know of anyone that actually has an AOW shotgun on a pistol permit? I have heard that people have done it but no one has actually shown me any proof. I called a gun shop that was listed on arfcom thread as having done the transfer and they said they have never done this type of transfer. Do you even have to be an SOT to do an NFA transfer? I thought a standard FFL could do one or two a year. |

I remember at a NY HTF shoot a few years ago someone had one. In July I'm going to approach Sheriff York in Livingston county and see if he will sign off. I am pretty sure you have to be an SOT to transfer in SOT stuff. |

thanks for the info. there is a guy in the Class 3 forum asking about a DD and the ATF not signing off on his form because new york requires a NYS DD Permit or something. No replies yet. Apparently he already has a M79. Could dealers own DD's and MG's? Yes, dealers can own DD and MGs as long as they are properly licensed. DD may be legal in NY too but I'm not sure, I would have to go back and reread the law. For a dealer to own a MG in NY they have to have a LEO demo letter. They can't just get MGs for personal use. |

Rich, take a look at Lakeville for a shop, besides I am 4 minutes from the town center Lakeville/Livonia is one of the locations I'm looking at. It would be a short drive from home (Springwater) yet still close enough to Rochester/Henrietta where people would still drive from the city to shop. The problem is there are few properties for lease south of the city that are suitable for a gun shop with warehouse space. |

AOWs are the only legal thing in NY. Smooth bore pistols which the ATF classifies as a NFA AOW are the only legal AOWs permitted in NYS. All other AOWs are illegal in NYS. The ATF agent just left and I should have my FFL in hand within a few weeks. |

The ATF agent just left and I should have my FFL in hand within a few weeks. So how did that interview go? Did they advise on additional requirements? The interview went real smooth, it only lasted about 45 minutes. The only additional requirements we discussed was the state licensing for handgun dealers and gunsmiths as well as some SOT stuff. |
