On the way into the city this AM, I had the misfortune of seeing a large deer hit by an auto in front of me. No one hurt in car, but deer was severely injured and staggering in the median between highway lanes. As a CHL holder, I had my sidearm. Would there have been negative consequences if I had "dispatched" the deer in order to avoid further risk to other motorists passing by (once the deer had fallen - i.e. clean shot)? I chose not to, but it pained me to see the deer suffering. I continued on my way with the hope that there would be no further accidents.

You should call the game warden and tell him what happened. He'll either come out there, tell you to shoot it, tell you to call someone else or tell you to leave it alone. Kinda depends on the game warden and where you live. They've got a lot of power in Texas, used to be they could forcibly open gates and go into your home to investigate game laws. There's also some "grey" areas where the head game warden tries to do the right thing and not stir up trouble.
We hunt out in west Texas and met our game warden this weekend. He's actually a pretty good guy. We had problems with some people driving up and down the road and parking at the end of our deer lease for unknown reasons and sitting in the cab in the dark. We told the landowner about it, he said the sheriff won't come out there (they don't patrol out there!). He said we'd be better off to call the game warden. When we told the game warden the story, he gave us his card with his home number and told us to call him if we have trouble. |

I seen four deer this Saturday that had been hit and killed along 377 south and 171. I start seening them this time of year along the road. Guess if I ever see one get hit or hit one myself I'll just leave it to suffer due to the crazy laws we have.

In the scenario, the deer could easily have caused another accident with human fatalities. |

Is it a felony to shoot a game animal with a suppressor? yes. yep which is why I wanted to make that distinction in my original post now, in "cutting said deer's throat" is it illegal/bad to keep the head when the deer is a trophy class buck? what if I "accidentally" veer into a neighbors yard "avoiding a squirrel" and hit a....I dunno..... 22"- 24" 10 point that is absolutely gorgeous. is that illegal? squirrels are important creatures too!! |

My local Warden is a friend and we had this conversation last year. You would/could be charged with illegally taking a game animal (basicaly poaching), and discharging a firearm in a Right-of-Way.
They are pretty serious about it. I cant say I agree with all that... B |

Shooting a deer with a suppressor isn't a felony. You would probably get hit with a Class A or B misdemeanor, for illegal means and methods. If you shot it you would probably be filed on for hunting from a public road. If it wasn't deer season, hunting deer in closed season. Right or wrong, we all hate to see deer suffer. Call the sheriff's office, they'll usually call a Game Warden. You cannot possess any part of a road killed deer either. There is a defense to prosecution for putting a wounded animal out of its misery; but it's just that, a defense after you've been filed on. |
| I popped a deer just last year with a G22, that had been struck by a vehicle. The accident broke both its back legs and probably its pelvis. I got two letters of commendation from citizens for showing some heart and compassion(if they only knew...lolol). I called the game warden right after I was through with the accident report. He said good job, If I knew someone that wanted the leftovers to give them a call. |
