Gents,

Was perusing an ad for ESAPI plates on another forum. Seller had the following fine print in ad.

"I will not sell this to you if you are a felon, unable to own a firearm, or are in CT or NY. I know CT prohibits non-face-to-face transfers of body armor unless between military or police, and last I heard NY is also considering a similar law, so to be safe I am not selling there either."

An exhaustive search of the interwebz has revealed nothing concerning such a proposed law, so I turn to you, the NY HTF.

Is there anything in the offing regarding body armor sales in NYS?

I just so happen to have the NYS penal law in front of me with the most recent inserts.

270.20 Unlawful wearing of a body vest.
     1. A person is guilty of the unlawful wearing of a body vest when acting either alone or with one or more other person he commits any violent felony offense defined in section 70.02 while possessing a firearm, rifle or shotgun and in the course of and in furtherance of such crime he wears a body vest.
     2. For the purposes of this section a "body vest" means a bullet-resistant soft body armor providing, as a minimum standard, the level of protection known as threat level I which shall mean at least seven layers of bullet-resistant material providing protection from three shots of one hundred fifty-eight grain lead ammunition fired from a .38 calibre handgun at a velocity of eight hundred and fifty feet per second.

The unlawful wearing of a body vest is a class E felony.

And according to section 265, a firearm is defined as any SBR, SBS, or any rifle/shotgun under 26", non compliant AW, or unlicensed handgun.

Crimes from 70.02 are violent felonies, e.g., rape, murder, kidnapping, sexual conduct against a child, burglary, ect.

So, owning and wearing body armor is legal if you aren't committing a violent felony. My best guess is that this law was geared at throwing another felony charge at violent offenders and not infringing upon lawful citizens.

I own and sell plates and soft armor all the time. Definitely legal to own, unless you're a felon.

so is not a good idea to quickly put it on, if a home invasion takes place, and you end up shooting the bad guy, because he has a pistol pointed at your chest?

A lot of sellers just automatically assume that if it's cool or fun it's illegal in NY. You can try to educate the seller but chances are he's going to be stubborn and refuse to sell. Happens all the time; just give your money to someone else.

I won't do business with anyone who has such policies. They do the work of the antis (think "useful idiots").

I know there's nothing on the books currently.

What I was wondering was whether those critters up in Albany were cooking up something new.
Kinda like: "CoBIS is finished, micro stamping kaput. How can we fuck with those gun nuts?"

So the specific question on my mind is: does anyone have any knowledge of pending legislation concerning body armor in NYS?
