I understand that AR is a must notify a LEO if you are carrying.  Not an issue there.  Was thinking though.   What happens if you're standing outside of your vehicle chatting with friends but your weapon is inside your vehicle you happen to be standing next to?  So LEO makes contact, reason does not matter, do you notify or not?   I'm gonna presume NO because you're not actually carrying at that point.   But what happens if you get Mr JBT?  lol

Didn't happen to me but was just considering possible circumstances.   All these things are running through my head.  Cooperate?   Am I being detained?  Etc, etc, etc

It must be official, lawful contact, your firearm must be readily accessible, and you must be in a place where it is required by law to have a CHL to be lawfully armed in order for you to have the "duty" to notify.

Per Admin Rule 3.2, it explicitly states that you must notify if you have a concealed weapon in your possession when asked for identification.  I would say if it is in your vehicle then you are not in possession, therefore there is no duty to notify, at least according to a strictly literal interpretation of the rule.

ETA:
Rule 3.2 Contact with law enforcement

(a) While in possession of a concealed handgun, the licensee shall present the original
license for inspection, along with an official form of photo identification, upon request
for identification by any law enforcement officer.
(b) In any official contact with law enforcement, if the licensee IS in possession of a
handgun, when the officer asks the licensee for identification (driver’s license, or
personal information, such as name and date of birth), the licensee shall notify the
officer that he or she holds a concealed handgun carry license and that he or she has a
handgun in his or her possession.
(c) In any official contact with law enforcement, if the licensee IS NOT in possession of
a handgun, when the officer asks the licensee for identification (driver’s license, or
personal information, such as name and date of birth), the licensee shall not be
required to notify the officer that he or she holds a concealed handgun carry license and
does not have a handgun in his or her possession.
(d) An official form of photo identification shall be, but is not limited to, any of the
following:
(1) Current and valid Arkansas driver's license;
(2) Current and valid military identification card; or
(3) Current and valid United States passport.
Effective date January 1, 2009 8
(e) Reproduced copies of the official form of photo identification or copies of the original
concealed handgun carry license shall not be accepted.

I think we can all agree that putting armed people at ease is a prudent idea.  Even when not carrying,  if I'm likely to be ran through acic, I'll say: "sir,  I'm not carrying right now,  but when you run me, it'll come back with a valid chl". It keeps them from being surprised when they do run you and see it. It also helps show that you're being open and honest.

Quick question.

The 3 times I have been pulled over since I have gotten my CHL, I always just hand them my license when I hand them my drivers license, even if I'm not carrying at the time.

Does that count as notifying?

Yes,  but a polite "my chll is there as well sir,  I'm carrying  on my right hip" or similar,  isn't a bad idea.

When I got my first CHL license back in Ohio I was taught by the lead attorney for the Buckeye Firearms Association (the leading state RKBA group) to inform the officer that you have CHCL, tell them if you are carrying and where the firearm is, if you are in a vehicle keep your hands in plain sight and don't move them, and then ask if the officer has any instructions for you.

I've been stopped twice since having a CHCL and used what I've learned above and the officers involved have been very appreciative and reasonable. Walked away with warnings on both stops.

"Officer, I have a valid concealed hand gun license and I am lawfully armed." This is always the first statement that I make when I am contacted by a cop or police officer. I wait for them to respond before I do or say anything else.

Hypothetical: You're standing in line at a convenience store and the officer in line behind you starts bullshittig with you about the 18" of snow on the ground.

This would not be considered "official contact", right?

When they run your driver's license, doesn't the system tell them that you have a CHL?

I've been stopped twice, but was not carrying on person or in car.  I just gave them my license.
Nothing was ever mentioned about concealed carry by either him or me.

I went through a roadblock last year that a bunch of troopers were working.  To make a long story short, he gave me a bunch of crap because I didn't hand him my CHL when he asked for my drivers license.  I did not have my handgun in my car since my job does not allow it.  Yes they do random searches:(   I tried to explain to him that I was not required to give him my CHL if I was not carrying but he kept giving me crap about it so I finally just handed it to him and said something like  "here, knock yourself out".   He obviously had never read that part.   What pisses me off the most, is that I didn't have anything with me to show him that he was wrong.

Well there is a distinct difference between when you legally must notify per statute, and when it is common sense to let them know to avoid any potential JBThuggery.  Legal requirement is outlined above - let your conscience be your guide if you should notify when not carrying, etc.

I got stopped in Texas by a Texas state trooper a few weeks back. Handed him my DL and CCL, all he said was "Thanks, it's just going to be a warning today.". Never asked if I had a gun on me or not and was very cool.

Due to my vocation, I deal directly with troopers in several states frequently. The ONE agency that I can almost always count on to go retard about CHL is the Arkansas State Police. One shining exception was a Trooper that conducted herself professionally and courteously during a recent stop. I would give her full credit, but I do not want to "out" her as a descent police officer. It is obvious that such are not the norm nor welcome in that pig stye of an agency.

I went through this last fall in Ravenden (a wide spot in the road in Sharp County, between Walnut Ridge and Hardy for those not familiar).  It's a known speed trap and he will nail you for doing 46 in a 45.  I actually got stopped because he said my windows were too dark.  When he walked up to the truck I guess he was kinda surprised to see an old gray headed fat guy instead of the young punk kid he was expecting to stop.  He asked for my license and ID and lectured me on how he could write me a $125 ticket for windows being too dark.  Now this is an old GMC pickup that I got from my 91 year old dad after he died in 2012.  He had bought it used and it already had the tint on the windows when he got it.  He drove it for about 10 years with no problems and I had driven it all over the state for 18 months before Mr Ravenden's Finest pulls me and my wife over.  Anyway, after the 5 minute lecture on the $125 ticket he"could" write me, he checks my license and comes back and starts on my ass about not showing him my CHL and now he's wondering what else I'm hiding.  I generally carry but didn't have anything on me that day.  He lectures me some more about how he could give me another $125 ticket for not showing my CHL.  I knew I didn't have to show it since I wasn't carrying and it really never entered my mind to show him since I wasn't carrying.  When I told him I wasn't carrying he told me that since I had the license I was required to show it whether I was carrying or not.

Rather than arguing the law and risking getting either 1 or 2 $125 tickets I just apologized and told him I'd remember the next time.

Guess you could have suggested ignorance of the law works both ways!  lol  Yeah that'd have went over well with him.   They make a device to check for window tint.    Seems like there was a thread about that in the past.

Was stopped by a UALR officer for having a headlight burned out. Wasn't carrying because we were on campus to watch our son-in-law play basketball. Handed him my license and registration, he went back and ran me, came back and went off about not presenting my carry permit. I explained if I wasn't armed I wasn't required to produce it. He disagreed. I tried to explain it would be like having to produce your fishing license when you weren't fishing. He was adamant I needed to produce even though I wasn't carrying. Gave me a warning for the headlight and sent me on my way.  Next day I called and had a nice chat with his boss. The officer called me later to apologize for his lack of knowledge of Arkansas CHCL laws.

Kinda sorta. Panda is correct you license plate number (LPN) does not show you have a permit but it does show the owners name. With JUST your name I can Query Name File (QNF) and pull up every John Doe in Arkansas with the town they live in listed. From there, choose the town the LPN is registered and bingo. While I worked in a communications center I'd say a competent dispatcher can do that in, 45-90 seconds.

Side note if you live in Conway, Conway Corp puts ALL your information in a gigantic pdf, (called "the Book") and give it to the police every 6-9 months. An entry is never removed, just added on to. Ive seen people that lived in town for 10 years, every address, every phone number, every late payment. All without a warrant. Very shady.
