Hello!
I applied for my CCW and it has been two weeks and have heard nothing! the sheriff said i would only take a day. I am worried that i they are going to deny me. I have had a felony in the past 10yrs ago but has been exponged since then. I have been able to buy guns and as far as i know I will have no problem getting the licence. Right? ANyone else have experience with this? |

Dude! I pretty sure they are going to trun you down. :( If I remember right the law said NO fellonies at anytime expunged or not.. You may want to call the attorney general and ask the question.
sorry to be the bummer This is from the AG office handbook on ccw The law states that you must not be under indictment, charged or convicted of a felony, a felony that involves the trafficking in drugs or similarly charged with a misdemeanor offense of violence or negligent assault. You may not obtain your license if you have been charged with falsification of a concealed handgun license |

Under the new bill if your felony has been expunged they can NOT use that as a disqualifier for your license. If everything else is okay you should be good to go. I just love the feds I pulled the info right off the AG web sight and it is wrong! Gotta Love em |

Gotta Love em It states on the CHL application with each question "Except for a conviction or guilty plea the records of which a court has ordered sealed or expunged". If the record was sealed (Expunged) the Sheriff canNOT disqualify you. |

Also, if you have moved recently between counties, or between states in the past, it will take longer while the request information from the other jurisdictions.
With your felony/expunge in the past, it might take longer. They may want to spend some extra moments to verify the issue. I wouldn't sweat until you hear something from the Sheriff |

The background check will usually take longer than a day and each county varies in their processing time, then the Sheriff has to sign each permit. There is a time limit built into the law too, regarding the wait...45 days. The problem is the 45 day time limit doesnt have any teeth. If they are late or take longer there is nothing you can do about it with out it costing you $$$$ If you havent check this out yet go to this website and read up. OFCC |
| They probably don't like the fact that the previous conviction is there and they may delay the acceptance up to the 45 days because of it. If it does go beyond the 45 days contact OFCC, they love bringing charges against the sheriffs to make them do their job. Ohio is a shall issue state and they are legally required to accept/ or deny (stating why in writing) within the 45 day period. |

There are no penalties for anyone if they go past 45 days. You can get a writ of mandamus, but it will cost you about $250.00 to file. Read This thread - here is a guy who waited 89 days to receive his renewal. |

I applied in Sandusky County and did not list my previous conviction. SInce then i have only had a few speeding tickets. I think it's just taking a little longer because the Sheriff wants to look at your sealed record which he has the right to do, BUT he can NOT disqualify you because of a sealed record. PLEASE keep us informed of the outcome of it. |

The sheriff may also feel the need to consult with the County's legal counsel. Most Sheriff's are not as well read on the law as we are and they might not be sure what to do with an expunged record. Counsel will research it and let the Sheriff know he needs to approve you (pending everything else turns out OK during the background check).
As much as it sucks, you need to wait the 45 days before contacting them. In all likelyhood, the Sheriff will be calling you before 45 days to inform you of your approval. |

Personal story from different counties.
I'm in Miami, took my class here and submitted my app 2 weeks later. I'm squeaky clean. Four of us in the class I know with 3 of us being coworkers. 11/12/08 the first submits app in Darke Co. 11/13/08 2nd (coworker)submits in Miami. 11/13/08 first get's his back in Darke. 11/17/08 I submit mine in Miami. 11/24/08 other (3rd)coworker submits his in Darke. We are all still waiting............
I know all of us have no record at all. So who the hell knows how long it takes. I know Miami is slow compared to some others, but with one getting it in one day and the other waiting I don't have a clue to the difference. |

While they were once a great organization, they can't even get a meeting with the legislature anymore. How do I know...I'm an elected official myself. (County level) |

Franklin County the first time it only took 1 day the renewal was less than 3 hours, It is rumored that Franklin Co. does nothing more than check your local records within the county and then approve. I had a nice long chat with the girl in the adjacent county where I got my CHL and she showed me where it literally takes longer to get a full check run than what Franklin Co. was issuing licenses in. |

Doe's your Sheriff's office have a number that you can call after x-amount of days?
The county that I reside in says that we can call and check after 21 days. It's been 28 days since your first post and you stated that you applied two weeks before that, that puts you within the 45 day limit by a day or two either way. |
