Ok, I got arrested and booked back in 2013 over b.s. I've been through the court process, everything was dismissed and most of my bail money was returned to me. Nowy wife and I are wanting to get our CHL, but I was told I would have to get that arrest expunged to be able to get my license. However, reading the rules on LSP website, it says I couldn't have been convicted of a felony or misdemeanor. Since I was dismissed, do I have to get that arrest taken off or will it show up regardless?

Nope. If you were not convicted you're good to go. I too was arrested then had charges dropped. All I did was send a copy of the letter I got from the DA saying my charge was dropped when I mailed in my application and fingerprints and all.

That's what I read, but I wanted to clarify with those in the know before I wasted anyone's time and money.

Ya know, when I typed my op out earlier I thought to myself- these guys probably think I'm some kind of trouble making asshole! That incident happened back in '07 and I never heard anything about it until I got pulled over by an ascension deputy and he informed me I had a warrant. He believed me when my wife had the exact same reaction to that bit of news. I asked the lawyer that handled my last run in about my CHL and he's the one who said I had to have it expunged.

Oh well, thanks brass! I think I owe you a lunch or some whiskey or something. You and capt morgan for all y'all's insight.

Innocent until proven guilty should mean something.

I can't see a reason for them to deny you without a conviction, but then again I'm not a lawyer.

When I bought my m-14 and then my FAL I had a hold on my NCIS.   I had a case that had been thrown out, but it was still on the books.   It was going to cost 2K to get it sponged off my record.   Well nature took care of it for me.   Hurricane Katarina got rid of all the records in basement of the Federal Court house in New Orleans.   No more waits, no more holds.

Well that worked out perfectly for you! The lawyer I talked to last time I had trouble was the one who told me that since I was actually booked that I would have to have that expunged to get my CHL. I called to see how much that was gonna cost and while it wasn't $2k, I still felt it was a bullshit amount especially seeing how I was cleared and everything was dropped.

If you have an active warrant (which must have been what the Ascension Parish deputy indicated) then you need to have that cleared before you do anything else. It can either be cleared-by-arrest (worst way!) or the issuing judge or DA's office can have it cleared, if they choose. You'll have to speak with someone "in-the-know" at the correct office regarding that. If you get transferred to the Clerk of Court, be sure it's the "Criminal" clerk and not the "Civil" clerk. It may be well-worth hiring a lawyer, but the people in those offices will usually steer you straight regarding the difficulty-level of whatever your problem may be. Good luck!

I'm assuming the warrant was cleared because I was arrested and booked. I bailed out, went through arraignment, trial and charges dropped and dismissed.

Trust me man, you're good to go. Just enclose paperwork proving the charges were dropped/dismissed. That's all I did and had no problem getting my permit.
