Long story short, I offered two sub guns for sale in-state to a fella 8 months ago and he paid me $X cash for both. He never filed in his paper-work until now, just sent me the Form 4's for my signature. Only now going thru a real bad $$$$ divorce and her Attn. has placed a stop on any selling of my (documented) property's until all issues are resolved. The fellow who purchased these two subguns now has to wait till my legal issues are completed. He waited mind you. Shall I offer him a full refund out of "pocket cash" or what? No bill or invoice was written. I need to contact him asap with this. I've just been handed a pile of shit and need to ...

Was not looking at divorce 8 months ago :(

I'm no lawyer or expert on the matter, but that's quite a chunk of dough to be questioning while going through a divorce. I think the question you should ask is "how much money will she get if I still make the sale, or how much money will she NOT get if I offer a refund?". the answer to that may help you decide which to do.

It sounds like he has both the guns and the guy's money...something is going to have to be delivered.  If the guy will take a refund the legal specifics are probably mostly irrelevant as he obviously can't keep both the money and the guns and an agreement to rescind any contract would serve him just fine.  It sounds like everyone is looking for performance under the original agreement enforceable contract or not.  The question is what can he do under whatever is controlling the marital assets right now, a question that should probably be directed to his attorney.  Once that is answered in terms of his divorce he should offer the easier course to the buyer and go from there.
