For those of you who have a C&R FFL for purchasing NFA weapons here in Missouri, I need a question answered. When your C&R gets close to its expiration date does BATFE send out a renewal notice? Or does a person have to file for a new C&R? What is the typical protocol for renewal? Thanks guys.

Mine comes up for renewal in january and i have just asked this question down at mid america. Al told me that to avoid problems I should get a form and send it in marked renewal well ahead of time. He seemed to think that the renewal form sent from the atf would show up conviniently late, and it was better to send it off early before I get the renewal notice than wait and have my FFL lapse putting me up a creek with regards to my newly aquired supressor.

Mine was due for renewal 3 months ago. I got the renewal paperwork 1.5 months ahead of the due date and returned it 2 days later by priority mail. I finally received my copy of the renewal 1 month after the date due. I had called the ATF @ 2 weeks till renew date in a panic and they explained that it had been received on time, and was in process but they were experiencing extremely high volume.(wonder why...) They were nice enough to send me a fax that stated my license was in renewal process and that the fax would work till I received the hard copy.

Same thing here.  I rec'd my renewal in jan and mine expired in March.  I literally rec'd mine March 28th or 29th..  I did call early March and rec'd the same story about being busy...

So it appears that due to the ATFs backlog of work one should plan to apply for renewal ~4 months ahead of the licenses expiration.  That's good to know.

I am concerned because my C&R expires January 2010 and I am going to be sending in Form 4's for 2 suppressors next week. Hope I do not run into any snags. Do you guys think that I will have any issues in my situation? Of course if my Form 4's come back to me within the next 3-4 months before the Christmas Holidays hopefully I will not have any issues.

Is the form to renew the same as the one for new? I ordered 5 of those thinking they were the same and hoping to get it sent off in september and have a few left over so I didnt have to worry about it next time. If they are the same and they get here before christmas your welcome to one.

My C&R expired in June. I received my renewal paperwork.in the last week of April. All went well. One must remember that the paper license in your hand, expired or not,  means nothing to the State of Missouri. I recommend that you sent a personal check to pay for the renewal. You have documentation that your license in in renewal status with the BATFE. They have the final word on your license status and Missouri has chosen to use that as the index on NFA ownership in Missouri.

The forms and the process are different for renewal and new application. The BATFE will send you renewal documents before your C&R expires.

Just a thought here guys, depending on how much of a hassle you can handle.  

Recently, a number of people have reported ATF doing compliance inspections of C&R FFLs.  It is not an uncommon practice for a person to let the license lapse, and then apply for a new license.  You are required to send any "business records" to ATF upon giving up your license, but since it is illegal to conduct business using a collector's license, there are no business records.  You still have to keep a bound book. You just don't have to turn it over when you give up your license, as it is not a business record.  

Now, the reason people let their license lapse is so if they do get audited, they only have a small bound book to review consisting of guns they acquired under the current license.  There is no requirement to enter guns into your bound book that you had prior to getting your (current) license.  

The problem with doing that here is that people need some type of FFL to legally own NFA stuff in this state.  If it's worth the hassle to you, you could move your NFA stuff to another state (Kansas is really handy to the KC folks, now that NFA stuff is legal there) while waiting on the new (not renewed) FFL to be issued.  You can actually fit quite a few stripped receivers and tubes (silencers) in a bank deposit box.

It's a pain in the butt, but I stored silencers in another state for 8 years until they recently became legal to own in MO.

I don't know if it's worth the hassle letting the license lapse in our circumstance, but I thought I'd at least bring it up.

Interesting. My last renewal had a question about how many guns I had purchased using my C&R. I told them one. (Sorry tell you but that  was really it, just one) Maybe that questions is used to try to identify C&R "dealers".

Don't feel bad.  My first C&R FFL almost expired before I used it the first time.  I had gotten the license specifically for the NFA in MO thing.  

I am pleased to say that the first C&R gun I bought with the license was also NFA.

Since we're on the subject of C&R FFLs, do I need to keep a bound book if I:

1) have not purchased C&R weapons
2) have no intention of purchasing C&R weapons

I only got it to fulfill the Class III requirement.

You will hear plenty of yes or no answers on that question.  Several people have said that BATFE gave them xx answer while BATFE gave someone else a completely different answer...

What I would do if I were audited and did not have any C&R guns is to bring a blank notebook.  Claim that's your bound book.
