Ok here is my situation.

Bought a car(Isuzu trooper) from a buddy about 3 years ago.  Paid him off in payments in like 6 months.  He couldn't find the title right away as he just went through a nasty separation then the woman he left his wife for died of cancer about a year later.  So I wasn't hassling him too much about the title.  I carried the insurance on the car and he would take a copy of it and get my tags for me.

Well finally he gives up on the search and goes to the tax office to get a new title printed up and they tell him there is still a lien on it from Chrysler Finance from when he bought it new in 1989 so they can't give him a clear title.  So some more time goes by and I start getting a little more insistent that he get off his ass and make some calls or write some letters.  Well after I leave a message on his phone one day, he sends me a email stating...."If and when I get you a title..it will be at My leisure".  WTF??  I've know this guy since 1990 and he pulls this crap on me.

Well obviously this friendship is over..but what are my options other than small claims court?  Can I file a mechanics lien even though someone else has a lien on it?  Can I even file a mechanics lien as a individual?  I have some some repairs and bought about a total of $450 in parts for the vehicle.

What are my options?

Give it back, get something else.  Thats what I'd do.  Since you cant get the title, you don't legally own it according to Texas unless you have a bill of sale signed by both of you.

If you do have the bill of sale, take it to the tax office and you should be able to get a new title.  I would call the tax office either way and find out what you need to do though to be sure.  Since theres an active lien on it, I think your screwed, but a lien from 1989 is most likely expired and you should be able to get a lien release.

Since it's still in his name....  Park it in handicapped spots everywhere you go.  Go downtown or wherever parking enforcement hangs out.  Turn it in if you have to.  Hell, take up three handicapped spaces at closed businesses.  Less likely to be towed if it's not actually blocking access.  

He'll call eventually.

Keep going through the toll ways.  After a few thousand in tolls he might get off his ass and do something.

Just contact Chrysler. They will release it to you.
