I need to create an LLC for a new business.  I've found the form online and it looks easy enough.  Is there any real reason to have a lawyer do rather than doing it myself?  Beyond filing it with the Sec State is there anything else I need to do?

Thanks

First, let me say that I am not an attorney nor CPA.

You don't need to pay one of those online companies $1,000 to fill out the form for you.  I think the fee to the State is (or was) $300.

You will need a EIN (Tax ID #) and maybe a Texas Sales Tax Permit.  Both are free and easy to do on-line.  You may need an Occupational License and/or permit.
Some cities have ordinances against running businesses in homes.  An FFL having a storefront (customers coming to his home routinely) for example.

There are other things you SHOULD do like open a separate checking acct, not co-mingle funds, etc.

You should visit with a good CPA to go over things such as these.  He can also advise if your LLC should have managers (page 4 on the Cert of Formation, which is not the same as a store manager), having more than one governing person, franchise tax filing requirements, etc.

Good luck!

Care to share what type of business you are starting?

Glad you said I didn't need a lawyer since I just sent it off.  Anyways, I'm starting up a computer consulting company to earn some money in my free time.  This is something that I've wanted to do for a long time, but the first two customers just feel in my lap and I figured it was time to do it.

Wish me luck.

And they are paying you?

You might need a lawyer after all

Pretty easy to do, I did it several months ago for my new company. Will need a EIN for the federal tax and do the form for the Texas franchise tax.

if you get a lawyer to do it they will probably write the operating agreement for you as part of the service they are providing.
