Sorry for another permit question but I have a lawyer friend who told me, even though I have a carry permit, I cannot drive with it loaded.  He seems to think the mag needs to be somewhere out of direct pop-in.   So....can I have my chambered pistol next to me ready to roll?

What you need is a can of Lawyer Repellent, just spray in the general area and they won't come near you.

This is false.

TN law doesn't mention loaded/unloaded.  You'll often see the phrase "with intent to go armed" in TN law.

It is a justifiable defense against the charge of carrying a handgun with intent to go armed if you have a carry permit.

Ask him to cite the specific code/law, and you can look up whatever he is referring to, but he is mistaken.

Yeah...he used the example of the Titan's QB getting arrested for having one in his glove compartment or something.  Was it Vince or Steve?  Probably didn't have a permit and that was it.

while walking, bicycling, driving, etc., as long as you are not someplace properly posted prohibiting such action.

Perhaps your lawyer friend is confused (as TN law is sometimes confusing!––gasp!!), because currently you cannot
carry a loaded Longarm (rifle or shotgun) in a vehicle.  We (TFA) are working to change that right now, so that you
will be able to carry a magazine-loaded rifle or shotgun––but with the chamber empty (thus, by law/definition, unloaded)
in your vehicle.

Currently, you may not have loaded magazines with the longarm.

Handguns, however, as long as you have a permit, are OK.  The Titans you mention did not have a carry permit.

Have to admit that with all the laws currently out there, and going back and forth, I may of missed something or confused with something else.

It just needs to be signed by the governor. If I'm not mistaken it automatically becomes law tomorrow if he doesn't veto it. The effective date on the bill is July 1.

Ok, just read thru that again. Appears that with the amendments(Amendment No. 2 to SB0578), still can not have ammo in a magazine/tube in the gun.

You can have a loaded magazine inserted in the gun, but you cannot have a round chambered. Amendments 1 and 2 were withdrawn. Amendment 3 was kept and added the stipulation that you could not have a chambered round.

My mistake re:  McNair.  Not a big fan of his, anyway.  You are correct, though.

Re:  "loaded" longarms:  unless Gov. Bredesen vetos it, it should become law shortly.  He's said
he doesn't have much problem with the parks bill, and I think he said the same about the longarms bill.

However, I'm not 100% certain on that (it's VBS week at church, & I'm a little tired right now!)

Fail. Might as well not carry ammo. After carrying for a while you'll get much more used to the idea, and less nervous. Just make sure you have a good holster and don't go finger fucking it for no reason.

It looks like the governor signed it friday and amendment 3 says the round cannot be chambered unless it's done for self defense.

Regarding carrying handguns in your vehicle in TN with a carry permit, if you're pulled over by a police officer you MUST notify him/her that you're carrying WITH PERMIT. Actually if you just hand him your license and carry permit card together, he'll ask if you're currently armed. You just say yes or no and he'll probably ask where the weapon is located––because he wants to make sure that you aren't going for it while you're chatting. Don't reach down and grab the weapon to show him. Just tell him where it is. I'm not sure I would retrieve it if they asked me to. I don't remember the law, but it sounds like a bad idea.

If you're NOT carrying and you don't offer info that you're a permit holder AND he runs your license looking for violations while in his patrol car, he WILL be notified that you're a permit holder and will probably challenge you about whether you're carrying or not. Go ahead and tell him you're a permit holder and not carrying in the first place. You don't have to, but why not?

A deputy pulled me over for not having my current sticker attached on my plate. I didn't notify him that I was a permit holder (and I wasn't carrying so I didn't have to), but he told me that he was notified that I was "permitted", and he quizzed me hard about whether I was carrying or not. After he left I stepped out to put the sticker on my plate (it was still stapled on the registration paper and current), and I realized that I had thrown my empty gun cabinet in the pickup bed to move to my new house. He never asked about that though.

Actually, you are NOT required to inform the officer that you are carrying. And I have never been "challenged" as to whether or not I was carrying and I have been pulled over several times since I've had my permit.
