My shooting buddy got a minor misdemeanor back in the 90s and is interested in having his record expunged. Is there a way to do that without hiring a lawyer?

Thanks.

Tis my understanding that a misdemeanor committed by a minor does not carry forward as an adult criminal record.  In the case of a misdemeanor committed by an adult, request a pardon from the govenor.

Is his reason for wanting his record expunged in order to obtain a CHL? If so as long as the incident didn't involve violence or drugs he'd probably qualify.

Minor misedeamnor is the lowest level of misdemeanor--not a misdemeanor committed while a minor. I believe that it is the same level of crime as a traffic violation--or close to it.

The crime was disorderly conduct for excessive noise while shooting in the woods behind a farm about 10 years ago. The neighbors complained. Tresspass charge was dropped. $50 fine. "Disorderly Conduct" looks bad on a background check, eventhough it could be something as benign as a loud party.

He contacted the court and they are sending him an expungement packet. $50 fee to have it taken of his record if the judge allows it. Seeing that it was an isolated "criminal" event in the life of an otherwise law abiding citizen, I don't think the judge would take issue.

As long as it is his only criminal violation it is able to be expunged. He doesn't need an attorney. Just fill at the packet, pay the money, and be at court on time. Expungments don't take long and the judge will call them when there is nothing else going on in the court room. If he's not there it will be denied and he'll have to refile.
