Miner & Dargan went round-and-round on this for a bit.  Miner was concerned that a janitor for the Dept of Corrections could go buy an AW after the ban.  Dargan said if the dept. buys the firearm for them to use on the job then anything goes. If it is a personal purchase then it must comply with laws for everyone else.  


These employees are, however, allowed to carry full capacity both on/off duty.

This is interesting and suggests that guns and mags for which orders have been placed can be satisfied.  Somebody tell AIM as they canceled a buddies mag order placed yesterday!

Q. If I own a gun that is going to be banned, what do I need to do?

A. If you own one or more of the assault style guns the bill now bans, you must register the guns with the Department of Emergency Services and Public Protection (D.E.S.P.P.) before January 1, 2014 and get a certificate of possession for that firearm. People in possession of newly designated assault weapons who fail to register their firearms will have committed a Class A misdemeanor for a first time violation. Subsequent violations of the law will be classified as a Class D felony. If you have bought one of these guns and are waiting for delivery, you will be allowed to keep it as long as you register the gun. If it comes with a large magazine, you will be able to keep that as well.

I've got a weird question

I've owned my "AW" guns legally but cant own pistols cause I have one of those misdemeanors on my record.


the top of the FAQ says I can reg and keep them. but at the bottom it says the certificate of possession requires a retro active background check..

I wont be able to get a long gun certificate because they added those 11 misdemeanors to the disqualifying factors for long guns.


am I still grandfathered or do I need lube?

I think that those misdemeanors will only affect you if you were guilty of them after the day the legislation was passed into law.

Thats what im hoping. the ammo certificate wording says only convictions after oct 31 so at least i can still buy ammo

True, but they do qualify as state military force, and have the exemption for post-ban mags. It would be hilarious to boost their numbers, and make the ban ineffective. Just another way to give stuttering Dan the finger.
