So i bought a preban lower on here a few weeks ago.  My FFL received it yesterday.

The seller included a copy of his DL.  The issue is his DL only has a PO box for an address and now my FFL will not release the lower to me unless he provides some sort of doc w/ a physical address.  He sent a copy of his conceal carry permit, it has no address on it.

Has anyone had this issue before or know of anything i can do?  im growing impatient.

Have the seller send a note with a physical address and have it notarized. Or does he have a car reg from NYS DMV with a physical  address, car insurance with address? Property tax bill, etc.

he said hes done this many times w/ no issue w/ the PO box, sounds like some FFL's werent paying attention...

A DL enclosed with the shipped gun is just a suggested ID method by the ATF. Unless something has recently changed which I don't believe is the case there is no requirement for it.

You could have it shipped to another FFL . You could try PRO GUN in Victor NY for the transfer. They are right off exit 45 on the NYS thruway. Probably  an hour or so from you. Your FFL should be able to release with what he has though.

Try asking if he has a notarized letter with a physical address if that would satisfy him.

this is straight from the atf's website.  seems pretty cut and dry to me.  i dont know why the FFL is worried about his address when its going to be in my name...?


Rochester is 2hrs from me.  The dealer im going through is 20 mins away and ive known him for 15yrs.

The FFL needs the name and address and must accurately enter that info within 24 hours in his A&D book. The easiest way for him to do that is enclosing a copy of the DL with the shipped gun from the person he acquired it from.

But his DL has no physical address, just a PO Box.  The FFL says this is unacceptable.....

I grew up always having a PO box on my license, i dont even think my parents have a street address to this day...

You cannot reside in a PO Box. The FFL needs a residence address and not the PO Box which is a mailing address.

Have the seller send/fax a copy of a utility bill or something in his name with his address on it.  That along with the DL should do it.  If not, then Passport or some other photo ID with his actual residence.  ATF requires actual residence on the 4473 and in the dealers bound book.

Not all residences have addresses. I have friends in the Hamptons that have no mail delivery. Some communities in Fire Island have no numbers,the houses have names, and what about people who live on boats?

Still nothing.  I've asked and so has my FFL for this guy to provide an address.

His license is current and so is his CCW, not sure why he wont give us some sort of address.

All you need is a combination of a .gov issued pic ID (DL, DMV nondriver ID etc.) to establish your identity and utility, tax or other bills in your name to establish your residence address. People who live on boats usually have a marina address with a slip number.

Is it a "PO" Box or a rural delivery route box?  If it's the latter, that is a physical location.  If it says something like "Route 22 Box 14" that is a rural route.  If it doesn't say "PO Box" then it's not a PO Box...

As mentioned, the dealer needs to log it in as coming from the seller with their physical address. Is the dealer actually required to take a copy of the ID with the address on it? I don't think so but it's just good practice to CYA. I am pretty sure all the dealer needs to do is verify the information, so having a copy of something is proof they did their job.

The couple times I have sold things and had my FFL ship them I have never included any of my information at all, nor did they ask for any.  Didn't know that was needed at all.

That was an FFL-FFL transaction; this sounds like a non-licensee to FFL.

The seller doesn't have to give you an address just the dealer. It makes no sense that he wouldn't do that unless his other info is fabricated. Welcome to limbo land as even if the guy refunds your money the lower has to be shipped back to his local FFL for transfer back to him.

I told him to send an address to my FFL.  He's now stopped respondig to my emails.  My FFL said he will call the ATF if needed....

Ok, got a reply.  He sent me his FFL info, so we may have to send it to his FFL then to my FFL so its a FFL to FFL transfer.

He has no street address.  My FFL is gng to call his FFL and see if there is a simpler solution.  Maybe I can actually have my lower next week.

Yes.   I wanna see if all this works out before I make a complaint...  I've already told the seller I was growing impatient and id take legal action if it wasn't resolved.  He offered a refund if we cannot get things worked out.
