I'm planning on trading a firearm with another WV resident and was just checking to see if there was anything that i'm missing. It doesn't look like we need to go through an FFL or anything but I was planning on typing up a "Bill of Sale" of some sorts to accompany the trade. I was planning on asking for a copy of the other party's DL or CCW (if he has one) and have him sign Anything you guys would do differently? Thanks in advance |

My wife and I just got our FFL in November.
You're good to go. A bill of sale isn't even required. That is just to protect you in case he claims s it to be stolen after the trade has gone through. It really almost seems to be pointless to have a transfer between 2 residents as well. If it were used in a crime, the trace would go to the FFL and he would just say it was originally transferred to you. LE might call you but in that case you would inform them you sold it and you are still within your rights since you are not required to have the license to sell in wv. The bill of sale would definitely help them if d the criminal if at large though... This is how I understand it at least. If I am wrong and there are more seasoned FFL holders here with documentation please chime in so as to educate me as well. Eta- in all honesty, I wouldn't personally give you my DL or ccw permit to copy if you didn't have an FFL and it wasn't a formal transfer. Not that you're wrong for asking. If you did ask me for it i would expect the exact same information from you without question. Maybe Im odd but it could rub somone the wrong way.. |
| I have bought and traded with nothing more than a handshake, then again. I also have written receipts as well. Depends on the situation. Though every time that I have bought a gun out of the paper. I kept the paper. With the ad and phone number of the person that I bought the gun from. Just in case. |

This only assumes that it has not been revoked for any rereason by the county law enforcement due to crime committed. It is up to the county level to seize that ccwp in such a situation. This also releases an FFL holder from that same scenario if they honor the law that passed a couple years ago allowing ccwp holders to bypass the background check if allowed by the FFL.This was directly from the atf agent that did our in home meeting/ training. |
