I was just reading on another forum, that a guy a guy went to pick up a new gun from a dealer on LI and they couldn't sell it to him without the casing which was missing. They said they would have to fire it to get the casing before they could let him have it.

I picked up a new HK usp-c recently and it didn't come with a spent shell. Is this an issue?

It didn't come with a spent shell because your dealer had already turned it in to the NYSP.

My FFL says the same thing.

New guns = must have casings.
Used guns = no samples.
He takes the gun(s) to the state barracks in Middletown to have the fired by the NYSP.

Of course, all of my guns purchased USED.

To be clear, NYSP's position is that only guns that come from a manufacturer directly to your FFL or from a distributor that regularly sells to NY must be tested.  NIB pistols from FFLs outside of NY that are not distributors don't need to be tested.

Of course, the law only requires that pistols coming from manufacturers and not distributors be tested, but since the NYSP feels like it can do whatever it wants to we need to comply.

NYS has spent wasted approx 24,000,000 on CoBIS. We're coming up o the six year anniversary of the system without solving one gun related crime. With that outstanding record the Dimwits in the NYS Assembly now want to expand the system to include ballistic testing of rifles. Idiots.
