40-4-22 concealing vin#
What is this and why would a ticket be issued for this? I've never seen this before but it crossed my desk today and I'm curious. Thanks! |

Don't need to be a LEO. The VIN Number must be visible so that tags and title numbers can be verified against the vehicle's VIN. As in if the VIN is removed one would think there is a high probability that the vehicle is stolen. So no covering over the VIN, removing, or grinding down. One of the reasons for hanging a Handicap Placard from the mirror is so it doesn't cover the VIN on the dash if the Placard is between the windshield and VIN on the dash. Its mainly for stolen vehicles or parts and/or masking or destroying the VIN to prevent detecting the fact that said VIN belongs to a stolen vehicle or part IE trafficking in stolen autos or parts by selling, buying, possessing. "40-4-22. (a) It shall be unlawful to buy, sell, receive, dispose of, conceal, use, or possess any motor vehicle, or any part thereof, from which the manufacturer´s serial numbers or other distinguishing numbers or identifying marks have been removed, defaced, covered, altered, or destroyed for the purpose of concealing or misrepresenting the identity of such motor vehicle. (b) Any person who knowingly violates any provisions of subsection (a) of this Code section is guilty of a felony and, upon conviction, shall be punished by confinement in the penitentiary for not less than one nor more than five years." |

its basically the same as OCGA 16-9-70 except it is specifically for motor vehicles.

16-9-70. Criminal use of an article with an altered identification mark (a) A person commits the offense of criminal use of an article with an altered identification mark when he or she buys, sells, receives, disposes of, conceals, or has in his or her possession a radio, piano, phonograph, sewing machine, washing machine, typewriter, adding machine, comptometer, bicycle, firearm, safe, vacuum cleaner, dictaphone, watch, watch movement, watch case, or any other mechanical or electrical device, appliance, contrivance, material, vessel as defined in Code Section 52-7-3, or other piece of apparatus or equipment, other than a motor vehicle as defined in Code Section 40-1-1, from which he or she knows the manufacturer's name plate, serial number, or any other distinguishing number or identification mark has been removed for the purpose of concealing or destroying the identity of such article. (b) A person convicted of the offense of criminal use of an article with an altered identification mark shall be punished by imprisonment for not less than one nor more than five years. (c) This Code section does not apply to those cases or instances where any of the changes or alterations enumerated in subsection (a) of this Code section have been customarily made or done as an established practice in the ordinary and regular conduct of business by the original manufacturer or by his duly appointed direct representative or under specific authorization from the original manufacturer. |
