Basically an Arkansas version of "castle doctrine" en.wikipedia.org/wiki/Castle_Doctrine |

Don't we already have this? I took my CCW class four years ago and the lawyer who did the Q&A with us told us we had it. He said that if they broke into your house then it was assumed that they were there to do bodily harm and you could nail them, even if they were not armed. Omni |

The bill would have it legal to defend yourself any where you had a right to be. I was there and spoke to the judiciary committee. The prosecutors assn. was able to convince the committee to gut the bill. Rep Burris refused to let them gut his bill so it was killed. I watched prosecutor after prosecutor get up and flat lie to them. One claimed she could not prosecute a drive by shooting if this bill became law. (The one that tried to gut the bill was a little Harry Potter lookalike from Jacksonville, I believe. Looked like Harry Potter except for no integrity.) I don't believe the committee members were stupid enough to believe them but what they did believe was that the prosecutors didn't want the bill. They put the prosecutors wishes above their constituents welfare. The prosecutors, of course, did not want to be held accountable. It made me sick to see public officials so crooked and dishonest. |
