Public buildings like the Cox Center, Ford/Chesapeake arena, public parks and the like that are funded by tax dollars. All those places have operational hours just like the Myriad Gardens. When public buildings are closed between 2300 (11pm) and 0600 (6am) are they required to keep their doors unlocked and allow the public to enter? The old guy I work with ("retired cop") says they have to because they operate with tax dollars. He tells me that just because State/City parks and buildings have hours, doesn't mean they can close their doors  I call Bullshit because the State Capital is a public building and I bet those doors are locked up tight at night!
Like the Okc protestor clowns. I told him that its fucked up that they go to a fed judge to get an extension to stay in Kerr park  but we at the Myriad have to tell people that the park is closed and ask them to leave. He went on his "its a public park" bullshit rant
Is there a state or city statute or law that spells this out? Whether a public place, park, arena, ect... has to remain wide open? He thinks that if I was to call the cops to escort someone off Myriad grounds that they would laugh at me and simply tell the person to leave, now while I don't doubt that, if its past 2300, that person or people are trespassing by definition. So with that said, it would be up to me to decide if i simply inform them the park is closed or call the cops. More often then not, unless they are trouble, Ill simply inform them of the rules and ask that they leave. Anyway, statute? law? provision? Anything out there to show me who's right? I do kinda want to know if Im right so I can shut him up, but if he's right then thats fine to. |

I'd suggest you call the local DA's office and ask them for a legal reference. They should be able to give you one without a problem. |
