Sorry but really do not have the time right now to look /read pages of codes or debate over what is legal. My wife's friend had a death in their family this past week. While going through stuff in the relatives house, they found a hand gun. Reportedly this was bought years ago in MD. All parties involved live in MD but they are not gun people and know nothing of gun laws. While I live in VA and know VA gun laws, I know nothing about MD's and I'm the only person they know that own guns. So here are my questions––
1-Is it legal to transport an unloaded handgun in the trunk of a car from one location to another? They do not want to leave it in an empty house. 2-Do you need to register handguns in the county where you live? They live in PG. 3-How do you sell a hand gun LEGALLY in MD? They do not want to keep it and are thinking they need to sell it as they are not gun people. Thank you in advance for any help with these questions. edit for some spelling |

Thank you in advance for any help with these questions. edit for some spelling Under federal law, a family member can claim the weapon under the inheritance rules with no FFL involved, but if they live in MD, they would have 5 days to run by a MSP barracks and fill out a 77R (see below). They can transport the weapon from one residence to another, however MD law prohibits anyone under age of 21 from possessing the handgun. I don't know if that is a factor. the weapon also needs to be in a case, bag or holster, it can not be laying 'naked'. No-one has to register a gun in MD, outside filling out the 77R (and that it isn't a machinegun, I'm also assuming it doesn't count as an assault pistol) Take it to a gun-store and sell it to them. (3) The Secretary shall waive the $10 application fee required under § 5-118(a) (2) of this subtitle for a gift purchased in accordance with this subsection. (b) Prohibited.- A person may not knowingly or willfully participate in a straw purchase of a regulated firearm. ETA_ the MDSP firearms FAQ says this: Can I acquire a regulated firearm through inheritance? Yes, provided the heir completes an application for the purchase or transfer of a regulated firearm and forwards it to the Secretary of the Maryland State Police. |
