Got a question for the Ohio folks. When did Concealed Carry become legal? My wife is from the Cleveland/Lakewood area (been here for about 15 yrs) She doesn't remember if it was "legal" for her Dad to carry back then. Thanks for any Info. |

It was never illegal to carry a concealed pistol in Ohio if there was a specific need. General concealed carry was illegal. Ohio had a "prudent man" defense until the passage of the CHL law. That defense no longer exists. A "prudent man" would certainly be armed while carrying large amount of cash to a bank for deposit, but the second the cash was deposited there was no longer any need to be armed and he'd then be in violation of the law. Ya gotta remember that all these gun laws were originally directed against Blacks and immigrants, not regular citizens who were rarely hassled for carrying concealed. I'm sure your Dad was prudently armed. In a challenge that restricting concealed carry violated the Ohio Constitution the Supreme Court of Ohio ruled that since open carry was legal in everywhere in Ohio the legislature could restrict concealed carry as the right to be armed would not be violated. CHL law made it illegal to open carry in your car unless you were licensed and then made it a requirement that it be in "plain sight" if you were. The requirement to open carry in the car will be gone in 6 weeks. -- Chuck |
good ole affirmative defense. |
| And in March of this year there will be less of the "Pain in the ass gun laws" Seem as if good old Bob Shaft (Taft) got his gun law broke off in his ass. So what that means is ,That all the cities that had there own weapons ban in there cities limits under the "Home Law". They will be crying in the beer in march when there local laws become null and void. All under the new state law. Enjoy |
