Help me out guys. Little background: I'm 20 years old, go to school in Maryland, lived there for the previous 7 or 8 years. Have my drivers license and tags on my truck and all in MD. However, my parents, my official residence, moved to Florida in November. I stayed in MD until May, came down here for the summer and got a job, and pay my taxes down here. I'm putting together an AR, and don't know if I can get a 16" barrel, or if I have to get a 20" HBAR. I'll be returning to school in two weeks, and have a place set up in Baltimore County.

Thanks,
-Andy

Since you are under 21, you have to go the HBAR route.  Any other AR-15 is considered a regulated "so called" assault weapon and you must be 21 years old to possess.

I learn something new that I don't like about this state almost everyday.

SBR's are legal here right?

Well I understand that if I were to buy it instate I'd have to get an HBAR, but can I buy it here in Florida and be "in-possession" in Maryland? As in we can be in possession of 30 Rd mags in MD but can't buy 'em there?

ah nice! Where are you living off campus?

I am down in Halethorpe near the post office (you might know the area as Fish Head Cantina).

Also, what range will you be going to?

Your residence is in MD. I don't think you can buy in Fla.
If you purchased it in Fla. while you still lived there, then yes, you can bring it to MD.

I'm no lawyer but if you domecile in MD and have a MD DL, then you are a resident of MD. Don't pay any Fla. income taxes.

If it behooves you gun-wise, then change your residence to Fla., buy your guns, move back to MD and get your licence back within 60 days.

This is the whole story as it applies to one who is under 21 yo - no loopholes.

IOW: Regardless of where/how/why or from whom you got your non-HBAR, if you are under 21, you may NOT **possess** the rifle while you are standing in MD, unless you are under the direct supervision of one who IS older than 21.

Stupid, but true.

FWIW, barrel swaps are easy and HBAR barrels are available in many configurations, including 16" pre-ban. It would be easy enough to comply with the 'letter' of the law and still enjoy your rifle while here.

Magazines are a totally different story, and confusing the two is a good way to find yourself in trouble. The law on magazines addresses "transfer", not "possession". The law on restricted firearms (non-HBAR AR-15s) addresses BOTH.

NOT true if the firearm in question is on the restricted fiream list. One must be 21 or older, period. Read the law.

Sorry if that was unclear. I wasn't referring to the age requirement.
The OP is a minor and that requirement quite clearly applies.

I recently went through some legal domicile issues that required a lawyer to clear up.
I was sort of hung up on that part of the post.
